Sec. 2.38.010. - Personnel Management.

To facilitate effective and economical service to the public, to enable equitable and uniform procedures for addressing personnel matters and to comply with applicable laws, the following personnel management program is adopted. The city reserves the right to make changes to the personnel management program and to any employment policy, practice, work rule or benefit at any time, without prior notice.

Sec. 2.38.020. - Adoption and amendment of personnel policies and procedures.

Personnel policies and procedures shall be adopted by the City Council. The personnel policies and procedures may establish regulations governing the personnel management program, including, but not limited to:

(1) Preparation, installation, revision, and maintenance of a classification and compensation plan, including employment standards and qualifications for each class.

(2) Appropriate procedures for recruitment and acceptance of applications for employment.

(3) Testing, selection and appointment procedures for employment.

(4) Evaluation of employees during an introductory period and thereafter.

(5) Transfer, promotion, demotion, reinstatement, disciplinary action and other personnel actions involving employees.

(6) Separation of employees from city service.

(7) Employment practices, including those necessary or desirable for legal compliance, for promotion of efficiency and for the proper management of the workplace and personnel.

(8) Leave and benefit programs.

(9) Employee standards of conduct.

Sec. 2.38.030. - Employment at-will.

All employment at the city is at-will and all employees of the city are at-will employees. Either the employee or the city may terminate the employment relationship at any time, with or without cause, and with or without advance notice. Nothing in this chapter, the personnel policies and procedures, in a contract for employment, or any other policy adopted by the city, may be interpreted in a manner that would cause the employee's employment to be other than at-will.

Sec. 2.38.040. - Administration.

The City Manager shall administer the personnel management program. The City Manager may designate a Human Resources Administrator or, in the absence of such a designation, shall serve as Human Resources Administrator. The City Manager shall:

(1) Act as the appointing authority for the city, except for the City Attorney who shall be appointed by the City Council.

(2) Administer all the provisions of this chapter and of the personnel policies and procedures not specifically reserved to the City Council.

(3) Prepare and recommend to the City Council personnel policies and procedures and amendments.

(4) Prepare or cause to be prepared, for adoption by the City Council, a position classification plan, including class specifications, and revisions of the plan.

(5) Prepare or cause to be prepared, for adoption by the City Council, a compensation plan consisting of pay rates and ranges, salary steps and hourly rates (as applicable) and each classification appropriately assigned.

(6) Have the authority, at his or her discretion, to discipline employees in accordance with personnel policies and procedures or to take action that is not-for-cause, consistent with the at-will nature of the employment relationship.

(7) Provide for the recruitment, application, testing, selection and appointment of candidates to appropriate positions in city employment in accordance with the personnel policies and procedures.

(8) Take other personnel actions in accordance with the personnel policies and procedures, including but not limited to transfer, demotion, reduction in pay, suspension, reprimand and termination.

(9) Have the authority to issue guidance and interpretations of the personnel policies and procedures and to issue administrative policies or regulations, provided the latter are not in conflict with the personnel policies and procedures adopted by the City Council.

(10) Performing any other duty that may be required to administer the personnel management program.

(11) The City Manager may delegate those portions of his or her responsibilities or authority as he or she deems appropriate.
