§ 2-1.101. Authorized.

This article is enacted pursuant to the provisions of Section 36516 of the Government Code of the State, authorizing the Council to provide by ordinance that each member of the Council shall receive a prescribed salary, the amount of which is based upon the population of the City as determined by estimates made by the Department of Finance of the State.

§ 2-1.102. Estimate of population.

As of March 2024, the latest estimate of population of the City made by the United States Census Bureau is 52,633.

§ 2-1.103. Compensation.

Each member of the Council shall receive as salary the sum of $2,386.00 per month, in accordance with the provisions of the Government Code of the State of California, which salary shall be payable on or after the date of adoption of the ordinance codified in this section.

§ 2-1.103.5. Benefits.

Pursuant to California Government Code Section 53208.5, each member of the Council shall receive health and welfare benefits at the same level as, and no greater than, the most generous schedule of benefits being received by any category of non-safety employees, subject to all limitations set forth in Section 53208.5(c) or any subsequent amendment thereto.

§ 2-1.104. Increases and decreases.

Following any new and later estimate of population made by the Department of Finance of the State placing the City in a population group other than that set forth in Section 2-1.103 of this article, the salary payable to each member of the Council shall be increased or decreased accordingly to equal the sum prescribed for that population group in Section 36516 of Government Code; provided, however, the salary as so increased or decreased shall become payable only on and after the date upon which one or more members of the Council become eligible therefor by virtue of beginning a new term of office following the next succeeding general municipal election held in the City.

§ 2-1.105. Reimbursement for expenses.

The salaries prescribed in this article shall be exclusive of any amounts payable to each member of the Council as reimbursement for actual and necessary expenses incurred by him or her in the performance of official duties for the City.

§ 2-1.106. Operative date.

The provisions of this article shall become operative only on and after the date upon which one or more members of the Council become eligible for the salary prescribed in this article by virtue of beginning a new term of office following in general municipal elections next succeeding February 16, 1966.

§ 2-1.107. Gift limitations.

Gifts to Councilmembers, as well as officers, employees and agents of the City, shall, except where expressly stated otherwise in this Code, conform to the limitations set forth by the California Political Reform Act (Government Code Section 89500 et seq.) and as required by the Fair Political Practices Commission (Code of Regulations Section 18940.2). For the purposes of this section, the term "gift" shall be defined and applied as used in Government Code Section 82028.
