2.40.010 - Definitions.¶
As used in this chapter, the following terms and words shall have the meaning ascribed to them in this section, unless otherwise apparent from the context:
Chief means the chief of police of the city of Hollister.
City means the city of Hollister.
City manager means the City Manager of the city of Hollister.
Member means a member of the Hollister police reserve.
Reserve means the Hollister police reserve.

2.40.020 - Created—Composition.¶
The Hollister police reserve is created and established. The reserve shall consist of such members as the City Manager may, from time to time, determine necessary; provided, that the number of members shall not exceed the number of regularly employed officers in the Hollister police department.

2.40.030 - Membership qualifications and standards—Appointment.¶
The chief of police, subject to the approval of the City Manager, shall, by rule, prescribe the qualifications and standards by which applicants for membership in the reserve shall be governed and those possessing such qualifications and conforming to such standards may be appointed to the reserve by the City Manager.

2.40.040 - Responsibilities of chief of police.¶
The chief of police, subject to the approval of the City Manager, shall prepare, adopt and promulgate such rules and regulations as may be necessary for the reserve, and shall enforce the same; shall have complete authority, command and control of the reserve; shall appoint administrative officers for the reserve from the officers of the police department; and shall provide and be responsible for the training of candidates for membership in the reserve and for the further training of members of the reserve.

2.40.050 - Reserve members designated as peace officers.¶
While on duty in the enforcement of the penal laws of the state or the penal ordinances of the city, and in the performance of such other duties as may be designated by the chief of police, every duly authorized member of the reserve shall be deemed to be and to have all of the powers of a peace officer.

2.40.060 - Duties generally.¶
A. Members shall perform such duties and public service as may be specifically directed or ordered by the chief of police or the chief of police's duly authorized agent.
B. Members of the reserve shall assist the chief of police and the police department in the enforcement of the law and the maintenance of peace and order and perform such other duties and services as directed or ordered by the chief of police at any time for the general welfare of the public, the police department or the city.

2.40.070 - Required amount of service.¶
Each member shall serve an average minimum of ten hours each month on duty or in public service. Any member who does not serve such minimum hours for a period of two consecutive months, without good cause, may, on recommendation of the chief of police, be dismissed from the reserve by the City Manager.

2.40.080 - Compensation.¶
The compensation, if any, for members of the reserve shall be fixed, from time to time, by the city council by resolution.

2.40.090 - Workmen's compensation insurance benefits.¶
Any member injured while on duty or in public service, which injury arises out of and in the course and scope of such duties or public service, shall be entitled to workmen's compensation insurance benefits based upon the compensation paid to probationary patrol officers of the police department of the city.

2.40.100 - Uniforms, badges and equipment.¶
The chief of police, with the approval of the City Manager, shall prescribe the uniform, badges and equipment to be worn and carried by members, and such uniforms, badges and equipment, with the exception of firearms, shall be provided by the city. On separation of a member from the reserve, either voluntarily or involuntarily, all uniforms, badges and equipment provided by the city shall forthwith be returned to the city.

2.40.110 - Carrying or using firearms.¶
A. No member shall, while on duty or in public service, carry or use any firearm unless the member shall have completed a course of instruction in the use of the same and have obtained a certificate to that effect signed by the chief of police and countersigned by the officer in charge of such training.
B. No member shall carry or use any firearm because of the fact of the member's membership in the reserve while the member is not on duty or in public service unless the member obtains a permit for the same as prescribed by law.

2.40.120 - Resignation—Termination of membership.¶
Membership in the reserve is voluntary and any member may resign at any time by submitting his or her written resignation to the chief of police. The membership of any member may, upon recommendation by the chief of police, be terminated by the City Manager at any time.

2.40.130 - Summary expulsion.¶
Any violation of law under color of the performance of a member's duties or in public service as a member of the reserve, or the breach of any of the rules and regulations adopted for the reserve by the chief of police, shall subject a member to summary expulsion by the City Manager.

2.40.140 - Impersonation of members.¶
Every person who falsely impersonates or represents himself or herself as a member of the reserve, or, while not a member thereof, wears, carries, displays, uses or possesses a badge, other insignia or uniform of the reserve shall be guilty of a misdemeanor punishable by a fine not exceeding $500.00 or by imprisonment not exceeding six months, or by both such fine and imprisonment.

2.40.150 - Punishment for resisting or obstructing reserve member.¶
Every person who wilfully resists, delays or obstructs any member in the discharge or attempt to discharge any duty of the member's office shall be guilty of a misdemeanor punishable by a fine not exceeding $500.00 or by imprisonment not exceeding six months, or by both such fine and imprisonment.
