10.44.010 - Bicycle defined.¶
Unless the provision or context otherwise requires, a bicycle is a device as defined, from time to time, in the Vehicle Code of the state.

10.44.020 - Applicability.¶
Any bicycle in the city shall be subject to all of the provisions of the Vehicle Code of the state and of this chapter.

10.44.030 - License required—Application.¶
A. No person shall use or operate any bicycle in the city without first obtaining a license therefor.
B. The city council, from time to time, by resolution, shall authorize and direct any officer, office or department of the city, and may authorize and direct any person, firm or corporation, to issue bicycle licenses upon written application therefor.
C. Each application shall contain the following:
The name and address of the owner;
The make of the bicycle;
The description of the bicycle;
The serial number or other identifying number of the bicycle; and
Such reasonable additional information required by the police department.
D. On issuance of a license for any bicycle, the license number and date of issuance shall be inserted on the application by the issuing agency.
E. On or before the fifth day of each calendar month, the issuing agency shall transmit to the police department such copies as may reasonably be required by the police department of each completed license application for licenses issued during the preceding calendar month.
F. The city council, from time to time, by resolution, shall determine and fix the period of time during which bicycle licenses shall be effective, which period of time shall not be less than one year.

10.44.040 - License fees—Penalty.¶
The city council, from time to time, by resolution, shall determine and fix the fee to be paid for each bicycle license, which fee shall be due and payable on the first day of January during the period of time which bicycle licenses shall be effective and shall become delinquent after the next succeeding 30th day of March. After delinquency, in addition to the license fee a penalty equal to 100 percent of the license fee shall be paid on the licensing of any bicycle. No penalty shall be paid on the licensing of any bicycle for the first time.

10.44.050 - Disposition of fees collected.¶
A. On or before the fifth day of each calendar month, any officer, office or department of the city authorized and directed to issue bicycle licenses shall pay all license fees and penalties collected during the preceding calendar month to the city finance officer for deposit to the general fund of the city.
B. On or before the fifth day of each calendar month. any person, firm or corporation authorized and directed to issue bicycle licenses shall pay 20 percent of all license fees and 100 percent of all penalties collected during the preceding calendar month to the city finance officer for deposit to the general fund of the city.

10.44.060 - Bicycle license plates or other devices.¶
A. The city shall provide bicycle license plates, stickers, tabs or other devices capable of attachment on the frames of bicycles. Such plates, stickers, tabs or other devices shall be numbered in numerical order and shall indicate the period of time during which the license shall be effective.
B. The issuing agency shall cause such license plate, sticker, tab or other device to be attached or affixed to the frame of each bicycle licensed, which license plate, sticker, tab or other device shall remain attached or affixed during the period ending with the date of expiration of such license.
C. No person shall remove, destroy, mutilate or alter any license plate, sticker, tab or other device issued pursuant to the provisions of this chapter.

10.44.070 - Destruction or alteration of serial numbers.¶
No person shall remove, destroy, mutilate or alter any bicycle serial number or other identifying number; provided, however, that the police department shall authorize the issuing agency to stamp numbers on any bicycle on which no serial number or other identifying number can be found or on which such numbers are illegible or insufficient for identification purposes.

10.44.080 - Bicycle transfers—Report required.¶
A. Every person, other than a person engaged in the business of selling new or used bicycles. who sells or transfers any bicycle shall report such sale or transfer within 30 days thereafter to the police department.
B. On or before the fifth day of each calendar month, every person engaged in the business of selling new or used bicycles shall report each sale or transfer of any bicycle during the preceding calendar month to the police department.
C. The reports required by this section shall contain the following:
The name and address of the person to whom the bicycle was sold or transferred;
The make of the bicycle;
The description of the bicycle;
The serial number or other identifying number of the bicycle;
The license number of the bicycle; and
Such reasonable additional information required by the police department.

10.44.090 - Bicycle transfer license required.¶
The purchaser or transferee of any bicycle shall, within 30 days of the date of sale or transfer, license the bicycle as required by this chapter. If the bicycle is currently licensed, no fee shall be paid for the transfer of such license.

10.44.100 - Reciprocity.¶
Any bicycle which is currently licensed in any jurisdiction in the state and for which fees have been paid to such jurisdiction shall be exempt from the payment of fees provided for in this chapter; provided, however, that any bicycle which is currently licensed in the city and for which fees have been paid to the city shall be exempt from the payment of any fees to such jurisdiction.

10.44.110 - Dealers to submit monthly report.¶
A. On or before the fifth day of each calendar month, every person engaged in the business of buying new or used bicycles shall report each acquisition or purchase of any bicycle during the preceding calendar month to the police department.
B. The reports required by this section shall contain the following:
The name and address of the person whom the bicycle was acquired or purchased;
The make of the bicycle;
The description of the bicycle;
The serial number or other identifying number of the bicycle;
The license number of the bicycle; and
Such reasonable additional information required by the police department.

10.44.120 - Police department not required to maintain records.¶
The police department is not required to maintain records required by this chapter after the records are, in the opinion of the chief of police, no longer necessary. Records which are not required to be maintained may be destroyed.

10.44.130 - Bicycle paths.¶
The streets and parts of streets in this city hereinafter described are established as bicycle paths, bicycle lanes and bikeways:
The east side of Prospect Avenue between the north line of Sunnyslope Road and the south line of Hawkins Street.

10.44.140 - Operating or riding bicycles or skateboards on sidewalks.¶
No person shall operate or ride a bicycle or a skateboard on any sidewalk in the central traffic district.
Any person who shall operate or ride a bicycle or a skateboard on any sidewalk outside of the central traffic district shall yield the right-of-way to any pedestrian thereon.

10.44.145 - Operating or riding bicycles in parking garages.¶
It is unlawful to ride or operate a bicycle in any parking garage owned, operated or controlled by the city.

10.44.146 - Operating or riding bicycles within skateboard parks.¶
It is unlawful to ride or operate a bicycle, scooter or similar device in any area designated or maintained by the city as a skateboard park.

10.44.150 - Impounding bicycles for violation of chapter.¶
In addition to any other penalty or penalties imposed with a violation of any provision of this chapter or of any provision of the Vehicle Code of the state relating to equipment requirements, the police department may impound and retain possession of any bicycle used or operated in violation of any of the provisions of this chapter or any provisions of the Vehicle Code of the state relating to equipment requirements, and shall release the same to the owner only for the purposes of complying with the provisions of this chapter or complying with the provisions of the Vehicle Code of the state relating to equipment requirements.
