15.26.010 - Preconstruction meeting.

For all projects of an estimated value of five hundred thousand dollars or more, the building official may require that there be a preconstruction meeting following completion of review by the architecture and design review board (and any subsequent review by the city council) and prior to the issuance of any permits in connection with the planned construction. At the preconstruction meeting, the owner, the contractor, and, if requested by the building official, the architect shall meet with the building official to discuss the construction project and its management. The building official may establish specific requirements for the project to meet to reduce construction impacts to the neighborhood, ensure compliance with any conditions imposed by the architecture and design review board and, if applicable, by the city council, as well as compliance with all applicable state and federal law and regulation, including, without limitation, stormwater management, recycling, construction schedule, parking requirements, and storage of construction materials and vehicles. Failure to adhere to such requirements may result in the issuance of a stop work order and shall constitute a nuisance under Chapter 8.16 of the Hillsborough Municipal Code. The deadlines set forth in Section 15.30.050 shall not be extended by reason of the issuance of any stop work order.

15.26.020 - Qualified superintendent on construction site.

In order to promote the timely completion of construction projects in accordance with applicable building standards and requirements and in order to administer the projects efficiently with respect to communications with the neighbors, with town building department staff, and with construction workers on the project, for all projects of an estimated value of five hundred thousand dollars or more, a qualified superintendent shall be present at the construction site at all times during the construction process, or at such times as the chief building official shall direct. However, due to the higher frequency of construction-management problems on owner-builder projects, if a building permit is issued to an owner/builder for projects with an estimated value of over 200,000 dollars, a qualified superintendent is required on site at all times during the construction process, or at such times as the chief building official shall direct. A qualified superintendent shall be someone with substantial construction experience and substantial knowledge of the rules and methods of construction. A homeowner shall not be deemed a qualified superintendent unless he or she meets the above description. The superintendent shall have the authority to address the concerns of neighbors, occupants, and town building department staff regarding the construction project and shall be present during all inspections and on-site visits by building department staff. The name and telephone number of the superintendent shall be conspicuously displayed at the construction site in a manner satisfactory to the chief building official.

15.26.030 - Construction management requirements.

A. For all projects of an estimated value of seven hundred fifty thousand dollars or more, the applicant shall submit and obtain approval from the building official for a construction management plan prior to issuance of a building permit including a construction schedule with phasing, parking plan, storage of construction materials and vehicles, location of portable toilets, dust control as applicable, delivery management, designated responsible foreman and contact information. Changes to the construction management plan require approval by the building official. Additionally, the building official may require a construction management plan for projects with an estimated value of less than seven hundred fifty thousand dollars in the event of three or more violations of this chapter associated with the site on which the permit applies. Approved construction management plans shall be implemented until construction has been completed as determined by the building official. The building official may require revisions to an approved construction management plan based on changes in existing site or area conditions or project phasing.

B. All construction vehicle parking shall be on-site unless otherwise authorized by the building official.

C. Portable toilets shall be screened from view from the public right of way and neighboring properties unless authorized by the building official.

D. Construction materials and vehicles shall be stored in an orderly and secure manner and screened from the public right-of-way or neighboring properties to the maximum extent feasible to the satisfaction of the building official.

E. The applicant shall provide a minimum seventy-two hour advance notice to adjacent neighbors of the commencement of construction.

F. The building official may hire an independent inspector at the expense of the property owner or contractor in the event of three or more violations of this chapter associated with the site on which the permit applies.
