Sec. 30-168. - Exemptions to the land application of manure.¶
The following sites are exempted from the prohibition of the land application of manure.
(1) Agricultural sites operated in conjunction with a public school with a recognized agricultural training program or curriculum.
(2) A tree or vine farming operation considered active by the director of planning.
(3) Operating farms which meet all of the following conditions:
a. The site has been approved as a valid agricultural operation by the director of planning and for which adequate CEQA clearances have been granted. Valid agricultural operation refers to an agricultural operation that produces crops for retail or wholesale use and which is zoned for agricultural uses. An approved application shall be obtained prior to the land application of any manure and shall be provided to any manure transporter as well as maintained on site during the land application of manure and incorporation into the soil. The director may, at his discretion, require some or all of the following:
A biological report for the property.
Other studies such as archaeological or paleontological reports which would facilitate any required CEQA determinations.
Access plans to the site including, but not limited to, haul routes to and from the city.
b. The site has a minimum of five acres of tillable soil as accepted by the director.
c. There is a distance of not less than ¼ mile from all public schools in session at time of application and incorporation into the soil.
d. There is a distance of not less than ½ mile from any sensitive receptor source such as a home for the aged or a senior retirement community.
