§ 12.20.010. Fence, signs, trees and branches at intersections.

A. Height of Fence. No person owning or in possession of real property located at or near the intersection of any streets shall erect, construct, install, plant, grow or maintain on such property any fence, signpost, hedge, shrubbery or tree in excess of thirty inches in height above the nearest curb, when such fence, signpost, hedge, shrubbery or tree is nearer than thirty-five feet to the point where the adjacent curblines, extended, intersect; provided, however, that this provision shall not apply to any person whose property is zoned for commercial or industrial uses and who, prior to erecting a fence as prohibited in this subsection, obtains a permit from the city building inspector to do so. Such permit shall not be issued without the approval of the city.

B. Overhanging Branches. No person owning or in possession of real property located at or near the intersection of any streets shall permit the branch of any tree on such property to hang or extend lower than seven feet at right angles above the nearest curb, when such branch is nearer than thirty-five feet to the point where the adjacent curblines, extended, intersect.
