5.16.010 - Christmas tree lots defined.

For purposes of this chapter, a Christmas tree lot shall include any developed or undeveloped property where Christmas trees are sold or stored.

5.16.020 - Application required.

No person shall sell Christmas trees within the City without first having applied for and received approval therefore in compliance with the terms of this title.

5.16.030 - Application contents.

A. An application must be submitted to the City Administrator on a form approved by the City Administrator or before November 1st of each calendar year. A separate application shall be submitted for each lot. Each application shall include but is not limited to the following:

  1. Name, address and phone number of the applicant/operator;

  2. Total number of employees (see Section 5.06.030);

  3. Name, address and phone number of the property owner;

  4. Name, address and phone number of the charitable organization (if applicable);

  5. The address where the applicant proposes to sell Christmas trees;

  6. A plot plan showing the location and layout (including lights, electric lines, parking, display area, sales stand) of the proposed lot;

  7. Affidavit of responsibilities.

B. Applicants for any such permit shall be notified by the City Administrator of the granting or rejection of their application for a permit on or before November 15th of each calendar year.

5.16.040 - Appeal.

Any applicant aggrieved by the decision of the City Administrator may file an appeal with the City Clerk within ten days of the date of notification. All appeals shall be filed in accord with Chapter 1.14.

5.16.050 - Duration.

Christmas trees may be sold from November 26th to December 25th of each calendar year. Construction of the lot may begin on November 20th and must be dismantled, with all debris removed, no later than 12:00 noon on December 30th of the same year that the permit is issued. The permit shall expire on December 31st of each calendar year.

5.16.060 - Fees.

Upon receipt of an application for a permit pursuant to this chapter, all required fees shall be submitted to the City Administrator or his/her designee. (See Chapter 5.06.)

5.16.070 - Inspections required.

In addition to any license fee required under the business license law, Chapter 5.06, an application to operate a Christmas tree lot on which there will be any construction or electrical work shall be accompanied with the required permits and fees to cover the costs of building and electrical inspections. Such fees shall be set by City Council resolution. All work shall be finaled by the Building Inspector prior to any Christmas tree sales.

5.16.080 - Deposit required.

In addition to the actual costs of the City to perform any inspections, the applicant shall submit a deposit of $200.00. Said deposit shall be to cover any damage or cleaning costs after the permit expires. The balance of the deposit not used shall be returned to the applicant within 60 days following the termination of the business in question.
