Sec. 4-70-010. Purpose. ¶
This Chapter describes the authority and responsibilities for the administration of this Zoning and Subdivision Code.
Sec. 4-70-020. Planning Agency. ¶
The Gustine City Council, Planning Commission, Planning Director, and Planning and Building Department shall perform the functions of a Planning Agency in compliance with Government Code Section 65100.
Sec. 4-70-030. City Council. ¶
The Council shall perform the duties assigned by the provisions of this Zoning and Subdivision Code to the Council.
Sec. 4-70-040. Planning Commission. ¶
A. Appointment. The Commission shall consist of five members appointed by the Council.
B. Duties and authority. The Commission shall have the responsibility and authority to: Conduct public hearings and approve or disapprove applications for Use Permits and Variances and recommend decisions to the Council on the approval of Planned Development Permits and Tentative Maps and adoption of and amendments to specific plans, amendments to the General Plan, Zoning Map, and this Zoning and Subdivision Code, development agreements, environmental documents, and other applicable policy or ordinance matters related to the City's planning process.
C. Architectural Committee. The Commission may appoint an Architectural Committee, consisting of three Commission members, to conduct the Architectural Review authorized by Section 4-52-020 (Architectural Reviews).
D. Subdivision Design Review Committee. The City Council may appoint a Subdivision Design Review Committee to review preliminary applications.
Sec. 4-70-050. Planning Director. ¶
A. Appointment. The Planning Director shall be appointed by the City Manager.
B. Duties and authority. The Planning Director shall:
1. Serve as the department head, and manage the day-to-day and long range functions of the Planning and Building Department;
2. Perform all of the functions designated by Government Code Section 65103;

3. Have the responsibility and authority to conduct public hearings and approve or disapprove applications for Architectural Reviews, Limited Term Permits, Planned Development Permits, Variances, Sign Permits, and Zoning Clearances;
4. Perform the duties and functions assigned to the Planning Director by this Zoning and Subdivision Code; and
5. Perform any other responsibilities assigned by the City Manager.
Except where otherwise provided by this Zoning and Subdivision Code, the responsibilities of the Planning Director may also be carried out by Department employees under the supervision of the Planning Director.
Sec. 4-70-060. City Engineer. ¶
The City Engineer shall perform the duties assigned by the provisions of this Zoning and Subdivision Code to the City Engineer.
