Chapter 10.52 — ELECTRIC CARTS ON SIDEWALKS

10.52.010 - Electric cart—Defined.¶
The term "electric cart" as used in this chapter means such devices as self-propelled battery operated wheelchairs or invalid tricycles and does not include golf carts and miniature toy motor vehicles.

10.52.020 - Permit required to operate electric cart on sidewalk.¶
It shall be unlawful for any person to operate an electric cart upon the sidewalks of the city without first having obtained an operator's permit to do so from the chief of police. Such permit shall be issued only when the chief of police or his or her designated subordinate is satisfied that the requirements of this chapter are met. Only physically disabled persons, persons over the age of fifty years, and employees of the United States Postal Service, state and local governmental agencies and public utility companies who operate an electric cart on a sidewalk during the course and scope of their employment may operate such an electric cart on a sidewalk in the city.

10.52.030 - Application for operator's permit.¶
An application for an operator's permit may be obtained from and filed with the city police department. The application shall be accompanied by the fee as established from time to time by resolution of the city council and proof of date of birth for those persons over age fifty years or in the cases of those persons claiming physical disability by a certificate of physical qualification to operate an electric cart completed and signed by a medical doctor. In cases of physical disability the chief of police or his or her designated subordinate must be satisfied that the applicant is incapable of physical exertion necessary to walk upon the sidewalks so as to conduct normal business and social activities.

10.52.040 - Registration—Identification sticker to be affixed to vehicle.¶
No electric cart may operate upon any sidewalk in the city without having first been registered with the city and affixed with an identification sticker evidencing the fact that the operator has obtained the necessary permit to operate said vehicle. It shall be unlawful for any person to operate an unregistered electric cart upon any sidewalk within the city.

10.52.050 - Maximum speed limit.¶
The maximum speed limit for an electric cart upon the sidewalk of the city shall be three miles per hour.

10.52.060 - Parking on sidewalks.¶
It shall be unlawful for any person to stop, park, or leave standing, whether attended or unattended, any electric cart upon the sidewalks of the city in such a position as to obstruct the complete width of the sidewalk.

10.52.070 - Exceptions.¶
Employees of the United States Postal Service, state and local governmental agencies, and utility companies while in the course and scope of their employment need not obtain an operator's permit or register any such electric cart with the city.

10.52.080 - Expiration of permit.¶
Any operator's permit issued pursuant to this chapter shall expire three years from the date of issuance unless otherwise renewed or if the person so permitted ceases to operate, own or lease the subject vehicle. All applications for renewal shall be accompanied by the appropriate fee as established by resolution of the city council from time to time.
