Chapter 10.26 — BICYCLES

10.26.010 - License—Required.

No person shall operate or use a bicycle, which is defined as any device upon which a person may ride, which is propelled by human or through a system of belts, chains or gears, and which has wheels at least twenty inches in diameter and a frame size at least fourteen inches, upon any of the streets, alleys or public highways of the city without first obtaining a license therefor from the police department.

10.26.020 - License—Fees.

A.

A three-year-license fee of one dollar shall be paid for each bicycle license issued pursuant to this chapter and shall be paid in advance. All bicycles operating in the city shall be licensed for three-year periods, the three-year program having commenced on the first day of January, 1975, and ended on the thirty-first day of December, 1977.

B.

The license fee shall be one dollar no matter when the license is obtained during any three-year period. Pursuant to Section 10.26.060, a bicycle license shall be obtained and such license may be transferred when the ownership of such bicycle is transferred, and a fee of twenty-five cents shall be paid for the registration of such transfer.

C.

All license fees collected under this chapter shall be paid into the general fund of the city.

10.26.030 - License issuance—Term.

The police department is authorized and directed to issue upon written application, bicycle licenses which are issued for a three-year period, the first three-year program having commenced on the first day of January, 1975, and ended on the thirty-first day of December, 1977. Such licenses when issued shall entitle the licensee to operate such bicycle for which such license is issued, upon all street, alleys and public highways, exclusive of the sidewalks thereof, in the city.

10.26.040 - License plate—Registration card.

The state Department of Motor Vehicles shall procure and distribute bicycle license indicia to the city. The chief of police of the city is authorized to procure from the Department of Motor Vehicles the bicycle license indicia in multiples of one hundred. Such bicycle licensing indicia shall be suitable for attachment to the frames of bicycles and it shall be the duty of the police department to attach one such bicycle in indicia to the frame of each bicycle and to issue a corresponding registration card to the licensee thereof upon the payment of the required license fee. The license indicia shall remain attached to the bicycle frame during the existence of such license.

10.26.050 - Records to be kept.

The chief of police shall keep a record of each bicycle license, such record shall include the license number, the serial number of the bicycle, the make, type and model of the bicycle, and the name and address of the licensee. Whenever the owner of a bicycle license pursuant to this chapter changes his address, he shall, within ten days thereafter, notify the chief of police of the address change.

10.26.060 - Report of sale.

It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer by returning to the police department the registration card issued to such person as licensee thereof, together with the name and address of the person to whom such bicycle was sold or transferred, and such report shall be made within ten days of the date of such sale or transfer. It shall be the duty of every person who purchases or otherwise acquires possession of a bicycle, to apply for a transfer of registration thereof within ten days of such sale or transfer.

10.26.070 - Removal of frame numbers, plates.

No person shall willfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame licensed pursuant to this chapter. No person shall remove, destroy, mutilate or alter any license plate, seal or registration card during the time in which such license plate, seal or registration card is operative. Nothing in this chapter shall prohibit the police department from stamping numbers on the frames of bicycles on which no serial number can found, or on which such number is illegible or insufficient for identification purposes.

10.26.080 - Impoundment.

In addition to any other penalty imposed for the violation of this chapter, the police department may impound any bicycle operated in violation of any of the provisions of this chapter and retain possession of the same until the license required under this chapter is obtained by the owner of such bicycle.

10.26.090 - Penalty.

Any person violating the provisions of this chapter shall be deemed guilty of an infraction, and upon conviction thereof, shall be punished by a fine not exceeding ten dollars.
