§ 7.17.010 CONSUMPTION OF ALCOHOLIC BEVERAGES IN PUBLIC PLACES OR PLACES OPEN TO THE…

(A) It is unlawful for any person to consume an alcoholic beverage, in or upon any public place or in or upon any place open to the public, whether such person is or is not in or upon any automobile or other vehicle or conveyance. The provisions of this section shall not prohibit the consumption of alcoholic beverages:

(1) At premises licensed by the State Board of Equalization under the State Alcoholic Beverage Control Act, Cal. Business and Professions Code Division 9 (commencing with § 23000), for the sale and/or consumption of alcoholic beverages on such premises; or

(2) At any special event conducted in or upon any public place for which a temporary license or permit has been duly issued by the Department of Alcohol Beverage Control.

(B) For the purpose of this section, an ALCOHOLIC BEVERAGE shall be as defined by the State Alcoholic Beverage Control Act.
