17.84.010 - Purpose.

In order to mitigate the traffic and road impacts caused by new development in the Brighton Crest Subdivision in the Millerton New Town area, Millerton Road must be widened and upgraded. The board of supervisors has determined that a development impact fee is necessary in order to finance these public improvements and to pay for Brighton Crest Subdivision's fair share of the construction costs of these improvements. In establishing the fee described in the following sections, the board of supervisors has considered the effects of the fee with respect to the county's housing needs as established in the housing element of the general plan.

17.84.020 - Millerton Road impact and improvement fee.

A road impact and improvement fee is hereby established and shall be imposed upon issuance of all building permits for development in the Brighton Crest Subdivision to pay for the widening and upgrading of that part of Millerton Road adjacent to Brighton Crest Subdivision. The board of supervisors shall, by resolution, set forth the specific amount of the fee, describe the benefit and impact area on which the development fee is imposed, list the specific public improvements to be financed, describe the estimated costs of these facilities, describe the reasonable relationship between this fee and the various types of new developments, and set forth the time for payment. As described in the fee resolution, this development fee shall be charged upon the issuance of a building permit and shall be payable by not later than the date of issuance of a certificate of occupancy or the date of final inspection, whichever occurs first. The board of supervisors may review this fee from time to time to determine whether the fee amounts are reasonably related to the impacts of development and whether the described improvements to Millerton Road are still needed.

17.84.030 - Limited use of fees.

The revenues raised by payment of this fee shall be placed in a separate and special account and such revenues, along with any interest earnings on that account, shall be used solely to pay for the widening and upgrading of that part of Millerton Road adjacent to Brighton Crest Subdivision.
