Chapter 13.04 — OBSTRUCTING OR INJURING HIGHWAYS

13.04.010 - Obstruction.

It is unlawful for any person to place or cause to be placed any obstruction or allow any obstruction so placed to remain upon any street or sidewalk of any unincorporated town within this county; provided, however, that the foregoing shall not apply to the necessary placing of building materials upon a highway or a street of an unincorporated town where such building materials are required for immediate use in the building of any structure, nor to the placing of bicycle racks on sidewalks, nor to permitted telegraph, telephone, electric light and railway poles, awnings or hitching posts, nor to goods in actual course of delivery, receipt or removal, with reasonable dispatch.

13.04.020 - Livestock—Grazing.

It is unlawful for any person to herd, drive, tie, stake out or otherwise allow any livestock belonging to him or under his control, to be in or upon any public highway for the purpose of grazing, except in an open range area as defined in Section 16801 of the Agricultural Code of the state and no animal shall be so tied upon or near any public highway or street of any unincorporated town as to allow such animal to graze upon any public highway or street of any unincorporated town within this county.

13.04.030 - Water on highways.

It is unlawful for any person to cause or negligently allow water from any ditch, canal, flume or reservoir (other than flood waters) to flow upon or saturate by seepage, any public highway of this county.

13.04.040 - Disturbing highway surface.

It is unlawful for any person, unless so authorized and directed by the commissioner of public works, or upon a permit issued by him, to plow, dig up or otherwise disturb the surface of any highway. Such permit may be issued by the commissioner of public works upon the following conditions only:

A.

That the person so authorized shall place proper barriers around the portion of said highway so dug up or disturbed, displaying red lanterns at night;

B.

That the person granted such permit shall be liable to any person for damage or injury resulting from such disturbance or digging up of the highway due to the negligence of the person obtaining such permit, or his employees.

13.04.050 - Street barrier sign obedience.

No person shall ride or drive any animal or any vehicle over or across any portion of a highway under construction, or any freshly painted marking in any street, when a barrier or sign is in place directing or warning persons not to drive over or across such highway, portion thereof, or marking, or when a sign is in place stating that the street or any portion thereof is closed.

13.04.060 - Interfering with traffic counting devices.

It is unlawful for any person except persons authorized by the director of public works, to move, interfere, tamper with car damage any traffic counting device located within a public road or highway.
