Article III — CONTROL OF BLOWING SAND AND SOIL EROSION

There are hereby adopted by the city, for the purpose of controlling blowing sand and preventing soil erosion by wind that affects health, safety, welfare and property, providing for the issuance of permits and the collection of fees, and providing penalties for the violations of such regulations, those certain code sections of the county enumerated in this section, three copies of which are on file in the office of the city clerk for public record and inspection.

Whenever the term "county" or "County of San Bernardino" is used in the county code sections adopted in this article, the term "city" or "City of Fontana" shall be substituted therefor.

The provisions for the control of blowing sand and soil erosion shall be applicable to all lands now within or hereafter annexed to the city lying within the territorial boundaries described in the county code sections adopted in this article.

All permits required under this article shall be issued by and all administrative enforcement proceedings shall be conducted by the county agricultural commissioner and the county soil erosion and dust prevention commission. All fees and costs shall be paid to the county.

The provisions of this article relating to control of blowing sand and soil erosion shall not be applicable in the case of abatement of weeds declared to be a public nuisance and ordered abated under the provisions of this Code.
