Sec. 29-41. - Applicability of article.

This article shall be applicable in those cases where other more specific provisions are not contained in the applicable articles of this chapter.

Sec. 29-42. - Appeals from decisions.

(a)

Any person aggrieved by any final decision of the bureau made in its administration of this chapter, if of the opinion that a decision of the bureau is an improper application or interpretation of this chapter, may appeal to the city manager.

(b)

All appeals taken under this section shall be taken within ten days from the date that the final decision of the bureau is mailed or delivered to the parties, by filing with the bureau and the city clerk a written notice of appeal specifying the grounds thereof. The bureau shall forthwith transmit to the city clerk all the papers constituting the record upon which the action appealed from was taken.

(c)

The city manager shall fix a reasonable time for the hearing of the appeal, give due notice to the parties in interest, and decide the matter within a reasonable time. At the hearing, any party may appear in person or by agent or by attorney.

(d)

The city manager may, in conformity with the provisions of this chapter, reverse or affirm, wholly or partly, or modify the order, requirement, decision or determination appealed from, and may make such other order, requirement, decision or determination as it sees fit.

Sec. 29-43. - Adoption of rules and regulations.

The bureau shall have, subject to the approval of the city council, power and authority to adopt such rules and regulations as are consistent with the provisions of this chapter.

Sec. 29-44. - Inspection of records.

(a)

The bureau shall have the right to inspect any and all books and records of any carrier at any and all reasonable times, and any carrier under this chapter shall keep adequate and complete books and records providing such detail as shall be required by the bureau, and failure to keep and maintain such books and records shall be grounds for suspension of any license or permit issued under this chapter.

(b)

The city shall have the power to request, if it so desires, an audited financial statement upon the registration, retirement or discharge of a franchised carrier's executive director or other managing agent or a majority change in the membership of the board of directors, or at any other time that the council desires.
