Sec. 26-316. - Initiation of proceedings.¶
Proceedings for reversion to acreage may be initiated by the city on its own motion or by petition of all of the owners of record of the real property within the subdivision.

Sec. 26-317. - Application.¶
All persons requesting approval for subdivided real property to be reverted to acreage shall file with the planning department a parcel map for reversion to acreage application in form, format and content as established by resolution of the planning commission. A parcel map shall be required pursuant to the provisions of article IV of this chapter.

Sec. 26-318. - Fees.¶
Fees for processing reversions to acreage pursuant to this article shall be established by resolution of the city council.

Sec. 26-319. - Hearing.¶
A public hearing shall be held on the proposed reversion to acreage in the time and manner prescribed by section 26-55.

Sec. 26-320. - Criteria for approval.¶
To approve a reversion to acreage, the planning commission must find as follows:
(1) Dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are unnecessary for present or prospective purposes; and
(2) Either:
a. All owners of an interest in real property within the subdivision have consented to reversion;
b. None of the improvements required to be made within two years from the date the final or parcel map was filed for record, or within the time allowed by agreement for completion of the improvements, whichever is the later, have been made; or
c. No lots shown on the final or parcel map have been sold within five years from the date such map was filed for record.

Sec. 26-321. - Conditions of approval.¶
In addition to any other conditions the city deems necessary, the following conditions shall be required for approval of reversion to acreage:
(1) Dedications or offers of dedication necessary for the purposes specified by local ordinance following reversion.
(2) Retention of all previously paid fees if necessary to accomplish the purposes of this division or any local ordinance adopted pursuant thereto.
(3) Retention of any portion or required improvement security or deposits if necessary to accomplish the purposes of this division or any local ordinance adopted pursuant thereto.

Sec. 26-322. - Effective date.¶
Reversion to acreage shall be effective upon the final map being filed for record by the county recorder, and thereupon all dedications and offers of dedication not shown thereon shall be of no further force or effect.

Sec. 26-323. - Effect.¶
When a reversion to acreage is effective, all fees and deposits shall be returned and all improvement security released, except those retained pursuant to section 26-321(2).
