Sec. 17-156. - Authority of council.

The city council may designate by resolution any public street or any portion thereof as a permit parking zone and establish the days and hours during such days when parking in the permit parking zone shall be restricted.

Sec. 17-157. - Criteria for designation.

(a) The city council may designate a permit parking zone when it finds that:

(1) Such zone is necessary to provide reasonably available and convenient parking for the benefit of the adjacent residences, adjacent businesses or adjacent government buildings.

(2) The zone is desirable to encourage the use of carpooling.

(3) The zone is desirable to enhance or protect the quality of life, property value or business in the area of the proposed zone.

(4) The zone will tend to encourage nonresident vehicles to park in offstreet parking facilities.

(b) Before making its findings with respect to any proposed permit parking zone, the city council shall consider such factors as it deems appropriate, including the following:

(1) Whether nonresident vehicles do or may substantially and regularly interfere with the use of the majority of available public street parking places in the proposed permit parking zone, and whether such interference occurs at regular and significant intervals.

(2) Whether nonresident vehicles driven, stopped or parked in the proposed permit parking zone are a source of unreasonable litter, noise, traffic hazard, environmental pollution or devaluation of real property in the area of the proposed permit parking zone.

(3) Whether the occupants, merchants or government officials of adjacent residences, adjacent businesses or adjacent government buildings in the proposed permit parking zone desire, agree to or request its establishment.

(4) Whether a shortage of reasonably available and convenient parking spaces exists in the area of the proposed permit parking zone.

(5) Whether unreasonable displacement of nonresident vehicles will result in surrounding areas.

(6) Whether an alternative solution is feasible or practical.

Sec. 17-158. - Parking restrictions.

The city traffic engineer shall mark established permit parking zones by placing and maintaining appropriate signs indicating that the parking of vehicles which do not display a permit or placard issued for such zone is prohibited and the hours and days when such parking is prohibited. During the hours and on the days designated on such signs, it shall be unlawful for the operator of any vehicle to park such vehicle on any public street in a permit parking zone unless there is displayed on such vehicle a valid permit or placard issued for such zone or such vehicle is otherwise exempt.

Sec. 17-159. - Parking permits.

Permits, of a type and design established by resolution of the city council, authorizing parking in the permit parking zone for which issued, shall be issued by the city licensing officer.

(1) Upon submission of such application and supplying such proof as is required by the city licensing officer, the city licensing officer shall issue to the occupant of an adjacent residence, the merchant or operator of an adjacent business, or the employees of an adjacent government building within a permit parking zone a number of parking permits for such zone, not to exceed three, except as otherwise provided in this section. The city licensing officer may issue more than three parking permits for an adjacent residence, adjacent business or adjacent government building if it is shown, by proof satisfactory to the licensing officer, that there are more than three vehicles registered to occupants of the adjacent residence, merchants or operators of the adjacent business, or employees of an adjacent government building, and that sufficient offstreet parking is not available to them during the restricted hours. The city licensing officer may issue to each adjacent residence two guest placards for use by authorized shortterm guests at the residence. The city licensing officer may, in emergencies, issue to any person an emergency parking permit for a period not exceeding three consecutive days.

(2) A permit issued pursuant to this section shall remain valid for so long as the person to whom it was issued continues to reside in the adjacent residence or work in the adjacent business or government building or until the permit parking zone for which such permit was issued is eliminated, whichever period of time is less. Upon transfer of the vehicle described in the permit issued under this section, or upon the permittee's change of place of residence, business or employment to an area other than that described in the permit, the person to whom a permit is issued shall return the permit to the city licensing officer.

(3) It shall be unlawful for any person to whom a permit is issued pursuant to this section to transfer, sell, rent or lease such permit or to allow such permit to be used on a nonresident vehicle not owned by the permittee or an authorized visitor of the permittee, either with or without consideration.

(4) It shall be unlawful for any person to borrow, buy or otherwise acquire for value or use any parking permit, except as provided for in this section. It shall be unlawful for any person who is not an occupant of an adjacent residence, a merchant or operator of an adjacent business or an employee of an adjacent government building to display in any vehicle any parking permit or placard issued pursuant to this section except while visiting an adjacent residence, an adjacent business or an adjacent government building in the zone for which the permit was issued.

(5) Each permit issued pursuant to this section shall be subject to all of the conditions and restrictions set forth in this section and of the permit parking zone for which it was issued, including conditions or restrictions which may be altered or amended from time to time. The issuance of such permit shall not be construed to be a permit for or approval of any violation of any provision of this Code or any other law or regulation.

(6) Where the city council determines that a fee is appropriate, it shall by resolution set fees for the issuance and administration of the permits in any designated permit parking zone.

Sec. 17-160. - Exemptions.

The posted restrictions of a permit parking zone shall not apply to commercial vehicles which are otherwise lawfully in use, stopped or parked within a permit parking zone, provided that such use, stopping or parking does not exceed a time which is reasonably necessary to complete its business.

Sec. 17-161. - Penalty.

(a) Any person violating any of the provisions of this division shall be deemed to be guilty of an infraction and, upon conviction thereof, shall be punished by:

(1) A fine not exceeding $100.00 for a first violation.

(2) A fine not exceeding $200.00 for a second violation within one year.

(3) A fine not exceeding $500.00 for each additional violation within one year.

Such violator may also be punished by revocation of the violator's parking permit issued under this division.

(b) A person violating any provision of this division shall be guilty of a separate offense for each and every day during which any violation of any provision of this division is committed, continued or permitted by such person, and shall be punished accordingly.
