7.10.010 - Garage sale and yard sale defined.

"Garage sale" and "yard sale" means a sale of personal property owned or used previously by an individual residing on the premises where the sale is conducted by such resident. The terms shall not include the mere incidental sale of one or two items of personal property when such sale is not part of a general sale of a number of items of personal property.

7.10.020 - Limitation on garage sales and yard sales.

No person shall conduct a garage or yard sale except pursuant to a permit issued by the city clerk and in accordance with the following limitations:

(1) No more than two garage sales shall be conducted on any premises by the same residents in any month. No more than four garage sales shall be conducted on any premises by the same residents in any calendar year. No single sale shall be conducted for longer than two consecutive weekends or forty-eight hours, whichever is the shorter period. Sales may be conducted during daylight hours only.

(2) Personal property offered for sale at a garage sale or yard sale may be displayed on a driveway, in a garage, on a front lawn, on a front porch, and in a rear yard, but not on the parkway or elsewhere upon the premises.

(c) Except as otherwise provided below, signs advertising a garage sale or yard sale shall be displayed only on the premises on which the sale is conducted. Two off-site directional signs may be permitted; provided the premises upon which the sale is conducted is not on a major thoroughfare, provided further that the signs will not constitute a traffic hazard or nuisance to neighboring properties, and provided further that written permission to erect or affix such signs is received from the property owners on whose property such signs are to be placed. The location of all such signs shall be noted on the permit. Signs may be displayed only on the days the sale is actively being conducted and shall be removed at the close of sale activities, or at nightfall, whichever first occurs, each day. No sign may be placed in any public right-of-way. Any sign not removed by the permittee, as provided above shall be removed by the city and the permittee shall be liable to the city in such sum per sign so removed as shall be set by resolution of the council. The city code enforcement officer shall present the permittee with a citation or statement for such charge.

(4) A nonprofit organization or nonprofit corporation may conduct a garage sale or yard sale at the residence of one of its members, pursuant to the requirements of this section. One such sale may be held per year without it being deemed chargeable to the premises in question for the purpose of applying the four-sale-per-year limitation set forth in subsection (a) of this section.

(5) No garage sale or yard sale shall be held so as to include more than one residence or parcel as the site of the sale unless a permit has been issued as required in subsection (1) of this section for each residence or parcel.

7.10.030 - Issuance of permit.

The permit required by this chapter shall be in writing in such form as shall, from time to time, be prescribed by the city attorney. The permit shall be issued by the city clerk upon satisfactory evidence that the applicant can comply with the provisions of this chapter, and upon the applicant's payment of such fee as set forth by council resolution, and any unpaid charges by the city for removal of signs posted by the applicant or for the applicant's conducting any unpermitted yard sales. Any yard sale conducted without benefit of permit as provided above shall be cited by the city code enforcement officer and in such an amount as set by resolution of the city council.
