Fillmore Municipal Code Ch. 3.32 Emergency Response Cost Recovery Program

The council intends that the city shall recover the costs incurred for emergency response and related activities by its police and fire departments, from violators of Vehicle Code §§ 23152 and 23153, pursuant to Government Code §§ 53150 through 53158.

The finance director shall take all reasonable measures to collect from each person arrested for a violation of Vehicle Code §§ 23152 and 23153, after an emergency response, all costs as may be directly incurred by the city for and during the emergency response, scene processing, report processing, and arrest and booking processing, according to the police contract rates and the fire department fee schedule prevailing, plus a fifteen percent overhead charge.

For the purposes of this chapter, "emergency response" includes any stop and arrest of a person in violation of Vehicle Code §§ 23152 and 23153, who has committed a hazardous moving violation as defined in the Vehicle Code, Division 11.

The finance director, as the collection agent for the city, is authorized to take all legal procedures to collect and shall account for the receipt and disbursement of funds collected under this chapter. In the event an arrest is not filed with the court, or an arrestee is acquitted by the court, then the finance director will refund any fees paid to the city by the arrestee.

The finance director shall collect pursuant to this chapter for costs incurred from and after July 1, 1990.
