Farmersville Municipal Code Ch. 15.16 Fire Code

There is adopted by the city for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that code known as the Uniform Fire Code, 1994 Edition, Volumes 1 and 2 by reference with the same effect as if fully set forth, except for Section 103.1.4 of Article 1.

Wherever the word "jurisdiction" is used in the Uniform Fire Code, it means the city of Farmersville.

The limits referred to in Section 79.501 of the Uniform Fire Code in which the storage of flammable or combustible liquids is restricted are established as follows:

All residential zones in the city.

Above ground fuel storage tanks may be allowed in commercial and industrial zones, if they meet those standards set by the fire department and after a conditional use permit has been granted.

The limits referred to in Section 82.105(A) of the Uniform Fire Code, in which storage of liquefied petroleum gas is restricted are established as follows:

All residential zones in the city.

The limits referred to in Section 77.106(B) of the Uniform Fire Code, in which storage of explosives and blasting agents is prohibited, are established as follows:

The entire city.

Whenever the uniform code adopted in this chapter specifies a board of appeal or advisory board, or in the absence of such specifications, the city council shall serve as a board of appeal, to determine the suitability of alternate materials and/or methods of construction and to provide for reasonable interpretation of the provisions of the adopted uniform code.

The code adopted by this chapter shall be enforced by the division of forestry, except as set forth in this chapter.

A. Any person who shall violate any of the provisions of this chapter, or who builds in violation of any detail statement of specification or plans submitted and approved thereunder, or any certificate or permit issued thereunder, and from which no appeal has been taken, or failed to comply with such an order as affirmed or modified by the city council or by a court of competent jurisdiction, within the time fixed in this chapter, shall severally, for each and every such violation and noncompliance, be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable as set out in Chapter 1.12 of this code. B. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense.

C. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
