15.04.010 - Adoption.

In compliance with California Health and Safety Code Section 17958, the State Buildings Standards Code, including the following Uniform Codes adopted, incorporated and modified thereby, as adopted by the State Building and Standards Code Commission pursuant to California Health and Safety Code Section 17922, is referred to, adopted and made a part of this chapter, except for the deletion of certain provisions as provided for within Section 15.04.020 of this chapter, with the same effect as if fully set forth herein:

A. The Uniform Building Code, Volumes 1 through 3, including all appendices thereto, 1997 Edition, published by the International Conference of Building Officials;

B. The Uniform Mechanical Code including all appendices thereto, 1997 Edition, as published by the International Conference of Building Officials;

C. The Uniform Housing Code, 1997 Edition, as published by the International Conference of Building Officials;

D. The Uniform Code of the Abatement of Dangerous Buildings, 1997 Edition, as published by the International Conference of Building Officials;

E. The National Electrical Code, 1996 Edition, excluding the appendix thereto, as adopted and published by the National Fire Protection Association, which is incorporated by this reference into the National Electrical Code, as adopted in and modified by the State Building Standards Code except as changed or modified by this chapter, and is adopted as the electrical code of the city of Farmersville.

F. The Uniform Plumbing Code, 1997 Edition, together with appendices thereto, as published by the International Association of Plumbing and Mechanical Officials.

15.04.020 - Deletion of certain code provisions.

The following sections of those uniform codes set forth in Section 15.04.010 are deleted:

A. All parts of Section 105 and Table 1-A, Building Permit Fees, of the Uniform Building Code;

B. All parts of Sections 110, 110.1 and 110.2 of the Uniform Mechanical Code;

C. All parts of Sections 203.1, 1201, 1303, 1304 and 1305 of the Uniform Housing Code;

D. Section 103.4.1 of the Uniform Plumbing Code;

E. Sections 203 and 304 of the National Electrical Code; and

F. All parts of Sections 205, 501, 502, 503, 504, 601, 602, 603, 604 and 605 of the Uniform Code of the Abatement of Dangerous Buildings.

15.04.030 - Definitions.

Whenever any of the following terms are used in said uniform codes, such terms shall have the following meanings:

A. "Building official" means the city manager or his designee.

B. "Chief appointing authority of the city" means the city council of the city of Farmersville.

C. "Chief of the fire department" means the county fire warden of the county of Tulare.

D. "City" means the city of Farmersville.

E. "Governing body" means the city council of the city of Farmersville.

F. "Chief electrical inspector" means the city manager or his designee.

G. "Administrative authority" means the city manager or his designee.

H. "Appeal board" means the city council of the city of Farmersville.

15.04.040 - Fees.

Any person, firm or company desiring a permit required by any of these codes shall, at the time of filing application therefor, pay a fee as set by resolution of the city council.

15.04.050 - Violations—Penalties.

A. It is unlawful for any person, firm or corporation to erect, construct, enlarge, alter, repair, move, remove, demolish, convert, equip, use, occupy or maintain any building or structure, or any portions thereof, in the city contrary to or in violation of the Uniform Building Code, Uniform Mechanical Code, Uniform Housing Code or Uniform Code for the Abatement of Dangerous Buildings or of this chapter, or cause, permit or suffer the same to be done.

B. It is unlawful for a person, firm or corporation to erect, install, alter, repair, relocate, add to, replace, use or maintain heating, ventilating, comfort cooling or refrigeration equipment in the city contrary to or in violation of any of the provisions of the Uniform Mechanical Code or of this chapter, or to cause, permit or suffer the same to be done.

C. It is unlawful for any person, firm or corporation to make any installation, alteration or repair of any electrical wiring, device, appliance or equipment in the city contrary to or in violation of any provisions of the Uniform Electrical Code, the National Electrical Code, or this chapter, or cause, permit or suffer the same to be done.

D. It is unlawful for any person, firm or corporation to install, remove, alter, repair or replace any plumbing, gas or drainage piping or any fixture or water heating treatment equipment in a building or premises, or to perform any other act, contrary to or in violation of any provision of the Uniform Plumbing Code, or of this chapter, or to cause, permit or suffer the same to be done.

E. Any person, firm or corporation violating any of the provisions of the Uniform Building Code, Uniform Mechanical Code, Uniform Housing Code, Uniform Code for the Abatement of Dangerous Buildings, Uniform Electrical Code or Uniform Plumbing Code or any appendices to said codes or other provisions of this chapter shall be punishable as set forth in Chapter 1.12 of this code.

15.04.060 - Copies on file.

A copy of said uniform codes shall be maintained in the office of the building official in accordance with the provisions of Government Code Section 50022.6.

15.04.070 - Appeal board.

Whenever the adopted uniform code specifies a board of appeal or advisory board, or in the absence of such specifications, the city council shall serve as a board of appeal, to determine the suitability of alternate materials and/or methods of construction and to provide for reasonable interpretation of the provisions of the adopted uniform code.

15.04.080 - Exceptions.

Those buildings which would otherwise be classified as a Group M, Division 3 occupancy under the Uniform Building Code and considered as agricultural buildings under Chapter 11 of the appendix to the Uniform Building Code but which do not have utility hook-ups shall be exempt from the provisions of this chapter and the uniform codes addressed by this chapter.

15.04.090 - Effective date.

The ordinance codified in this chapter shall go into effect and be in full force and effect at 12:01 a.m. on the thirty-first day after its passage.
