§ 2.28.010 ESTABLISHMENT.

The Planning Commission is established in and for the town.

§ 2.28.020 POWERS AND DUTIES.

The Planning Commission shall perform all of the duties and obligations required of it by the laws of the State of California and the provisions of this code, and shall perform such other duties as may be assigned to it by the Town Council.

§ 2.28.030 COMPOSITION; APPOINTMENT OF MEMBERS.

The Planning Commission shall consist of seven members, to be appointed by the Town Council in accord with the general rules governing Council action.

§ 2.28.040 TERMS OF OFFICE; FILLING OF VACANCIES.

(A) Other than ex officio members, who will serve during their respective terms of office, members of the Planning Commission shall serve for a period of four years, which terms, fixed by resolution of the Town Council, shall be staggered so that no more than two terms shall expire in any one calendar year.

(B) Successor Commissioners for a new term shall be appointed for a period of four years.

(C) Vacancies which occur other than by expiration of term shall be filled by appointment for the unexpired portion of the term vacated.

§ 2.28.050 REMOVAL OF MEMBERS.

Any appointed member of the Planning Commission may be removed by the Mayor, with or without cause, with the concurrence of the Town Council.

§ 2.28.060 RESIDENCY REQUIREMENTS.

Other than ex officio members, members of the Planning Commission must be residents of the town in order to be eligible for appointment to the Planning Commission.

§ 2.28.070 COMPENSATION.

The members of the Planning Commission shall not receive any compensation for their services.

§ 2.28.080 QUORUM.

Four members of the Planning Commission shall constitute a quorum for the transaction of business and the affirmative vote of a majority of a quorum shall be sufficient for action by the Commission.

§ 2.28.090 MEETINGS; GENERALLY.

The members of the Planning Commission shall meet at least once each calendar month, at such times and places as may be fixed by resolution.

§ 2.28.100 SPECIAL MEETINGS.

Special meetings of the Planning Commission may be called at any time by the Chairperson or by five members by written notice served upon each member of the Commission at least three hours before the time specified for the proposed special meeting.

§ 2.28.110 RECORDS OF PROCEEDINGS.

Action minutes and records shall be kept of the proceedings of the Planning Commission so long as an electronic recording of the meeting is available. If an electronic recording is not available detailed minutes and records shall be kept.

§ 2.28.120 CHAIRPERSON.

(A) Planning Commissioners shall meet in regular session and elect a chairperson and vice chairperson. The election shall be by a majority vote of the Commission, to be held in December of each year. The term of service for these offices shall be one year, beginning in January of each year. No commissioner shall serve more than two consecutive full terms as chairperson of the Commission.

(B) The chairperson shall preside over all Planning Commission meetings. The vice chairperson shall preside in the absence of the chairperson.

(C) Should a mid-term vacancy occur in the Office of Chairperson, the vice chair shall assume the role of chair for the remainder of the term and a new vice chair shall be elected.

(D) Should chair and vice chair be absent members shall elect a chair pro tem.

§ 2.28.130 EXPENSES.

The Town Council may, in making its annual tax levy and as a part thereof, levy and collect a tax for the purpose of defraying the lawful expenses incurred by the Planning Commission, not to exceed two mills on the dollar of assessed valuation; provided that, no expense of any kind shall be incurred by the Commission unless first authorized and approved by the Town Council.
