Sec. 3.36.010. - Purpose.

The purpose of this chapter is to designate the County as an Article XIX county under the California Constitution allowing the expenditure of State fuel and use taxes for public mass transit guideways.

Sec. 3.36.020. - Power to expend State fuel tax and use revenues.

The County is authorized to expend State revenues allocated to the County from taxes imposed by the State on motor vehicle fuels for use in motor vehicles upon public streets and highways for the following purposes in addition to those purposes otherwise authorized by law:

A. The construction and improvement of exclusive public mass transit guideways and their related fixed facilities, including the mitigation of their environmental effects;

B. The payment for property taken or damaged for such purposes;

C. The administrative costs necessarily incurred in the foregoing purposes; and

D. The maintenance of the structures and the immediate right-of-way for the public mass transit guideways, but excluding the maintenance and operating costs for mass transit power systems and mass transit passenger facilities, vehicles, equipment and services.
