Sec. 3.35.010. - Title.

This chapter shall be known as and may be referred to for all purposes as the County Booking Fee Ordinance.

Sec. 3.35.020. - Purpose.

It is the intent of this chapter to adjust fees for reimbursement of County expenses in regard to booking or other processing of inmates into the County jail pursuant to the authority of Government Code § 29550 et seq.

Sec. 3.35.030. - Definitions.

As used in this chapter, the following definitions shall apply:

Booking fees means all fees for booking or other processing of inmates into the County jail as provided in Government Code § 29550 et seq.

Sec. 3.35.040. - Fees.

The jail booking fees set forth in this section are adopted and chargeable to the respective cities as follows:

A. For book and release:

  1. City of Placerville: $112.00.

  2. City of South Lake Tahoe: $115.00.

B. For book and house:

  1. City of Placerville: $115.00.

  2. City of South Lake Tahoe: $118.00.

Sec. 3.35.050. - Procedure; annual review process.

To ensure that fees continue to reflect the cost of the service provided, County staff is directed to recalculate the fees annually after adoption of the final budget and shall present the recalculated fee to the Board of Supervisors for adoption by January 1 of each year for implementation effective July 1 of each year.

A. That fee may be adopted only after the County has provided each affected local agency 45 days' written notice of a public meeting held pursuant to Government Code § 54952.2 on the fee increase, and the County has conducted the public meeting.

B. The County shall negotiate a reduced fee with any affected local agency within the County for any services performed by the arresting agency in the processing of arrestees that do not have to be duplicated by the County.

C. The provisions contained in this section do not apply to fees charged affected local agencies with whom the County has a contractual relationship.

D. The exemption of a local agency from payment of a fee pursuant to this section does not exempt the person arrested from the payment of fees for booking or other processing.
