13.16.010 - Application.

Any property owner planning the construction of any street, road, alley, or path for public use, must submit a scaled contour map for planning commission review and recommendation, with the location of the proposed right-of-way drawn thereon. The contour map must be accompanied by the fee set forth in the city's master fee schedule. This section and Section 13.16.020 are not applicable to subdivisions, which are governed by the provisions of Title 18 of this code.

13.16.020 - Approval.

The recommendation of the planning commission regarding such application will be referred to the council. The council may, at any regular meeting thereof, either grant or deny approval for construction of the proposed right-of-way.

13.16.030 - Map—Filing.

After council approval of the plan and prior to actual construction of said right-of-way, the property owner must file with the city manager three copies of a map showing the location and extent of said street, road, alley or path. Acceptance of said map is conditioned on compliance with the following requirements:

A. The map shall be made from a record of a survey of said street, road, alley or path made by a registered civil engineer or licensed land surveyor.

B. The survey shall be of such accuracy that a traverse computed from field measurements of said street, road, alley or path shall close on the boundary dimensions of said owner's property within a limit of error of one foot to fifteen thousand feet of perimeter.

C. In making the survey of said street, road, alley or path, the civil engineer or land surveyor shall set permanent monuments of a type approved by the city manager, and of sufficient number that said survey may be retraced on the ground. Such monuments shall be located and recorded on the map described in subsection A of this section.

D. A performance bond in the amount of one hundred percent of the cost of the work shall be filed by the property owner with the city manager.

13.16.040 - Map—Disposition.

All maps received by the city manager under the provisions of Section 13.16.030 shall be filed as follows:

A. One copy shall be indexed on a map of the city and filed for the convenience of the public;

B. One copy shall be filed in the official records of surveys and maps in the city;

C. One copy shall be filed in the official records of the county.
