15.44.070 - Definitions.

For the purpose of this article, the following terms are defined:

"Habitation" means use for residential purposes as well as nonresidential office purposes, retail business purposes, educational and/or public health purposes.

"Mobilehome" is defined as a manufactured home. Mobilehome is further defined as a transportable structure in one or more sections designed for residential use and was constructed after September 15, 1971, and was issued an insignia of approval by the California Department of Housing and Community Development or was constructed after July 1976, and was issued an insignia of approval by the U.S. Department of Housing and Urban Development and has not been altered after the issuance of such insignia.

"Vehicle" means any camp car, camper, trailer or other vehicle with trailer, motor home, or other vehicle, with or without motive power, designed and constructed to travel on the public thoroughfare in accordance with the provisions of the California Vehicle Code, which unit is designed or used for human habitation.

15.44.080 - Compliance required.

A. It is unlawful and a public nuisance and menace to public health and safety for any person, firm or corporation to use a vehicle subject to this article at any place within the city limits of the city, except as herein provided.

B. No vehicle subject to this article shall be used for permanent habitation except as provided in this chapter.

15.44.090 - Temporary nonresidential use.

Temporary nonresidential use of vehicles subject to this article is permitted when the use of such vehicle is necessary to the construction of permanent structures within the city limits. Prior to such temporary use, a permit for such use must be obtained from the director of public works of the city. Said permit shall permit use for a period not to exceed one hundred twenty (120) days. Any extension or renewal of said permit shall be at the discretion of the city council of the city. The subject permits shall state the specific location of the vehicle and shall not be transferable.

15.44.100 - Emergency temporary use.

Emergency temporary use of nonresidential vehicles may be permitted by the city council. The city council reserves the right to determine whether or not the condition existing is in fact an emergency, and in the event that it declares an emergency to be extant, the city further reserves the right to determine the terms and conditions of the emergency permit.

15.44.110 - Public health or educational use.

Vehicles, the subject of this article, when used for public health and/or educational purposes, may be parked upon the streets lying within the city for a period not to exceed ten (10) days. A permit for this purpose must first be obtained from the chief of police of the city.

15.44.120 - Retail sales use prohibited.

In no event shall vehicles subject to this article be used for retail sales purposes.

15.44.130 - Conditions and regulations.

Mobilehomes as described in Section 15.44.070 shall be allowed to be placed in a residential zone on individual lots as follows, and a mobilehome shall:

A. Be given architectural approval by the planning commission prior to issuance of a building permit as per compatibility to the neighborhood;

B. Be occupied only as a residential use;

C. Be subject to all the provisions of the city's zoning ordinance for residential structures;

D. Be attached to a permanent foundation system as required in the Uniform Building Code for residential structures;

E. Have a minimum width of twenty (20) feet;

F. Have a minimum length of fifty-five (55) feet;

G. Be covered with exterior materials customarily used on conventional dwellings; the exterior covering material shall extend over the foundation the same as conventional buildings;

H. Have a roof load design for a sixty (60) pound per square foot snow load;

I. Have a roof pitch of not less than three inches vertical rise for each twelve (12) inches of horizontal run;

J. Have a roof covering consisting of materials customarily used for conventional dwellings within the neighborhood that the mobilehome is proposed to be placed;

K. Have a plot plan showing the proposed location of the mobilehome on the lot;

L. Be subject to all the provisions and ordinances that apply to all other residential buildings;

M. Be required to have porches and eaves or roofs with eaves when in the opinion of the planning commission it is necessary to have the mobile- home compatible with other dwellings in the area.

N. In those instances where review is performed as specified in Section 15.08.050 of this chapter, the planning commission may consider evidence generated from said review.

15.44.140 - Building permit.

A. After architectural approval by the planning commission, a building permit shall be issued for the installation of the mobilehome. Issuance of the building permit shall require that the applicant:

  1. Comply with all the conditions of the architectural approval;

  2. Comply with all the requirements of the city building codes and ordinances where they may apply;

  3. Include a foundation system plan.

a. A foundation system is an assembly of materials constructed below a mobilehome and below grade for frost protection not intended to be removed, which is designed to support the mobile-home structure to resist the imposition of external natural forces.

b. The foundation system shall be designed in accordance with the Uniform Building Code and local soil conditions.

c. The foundation shall be designed to withstand sixty (60) pound per square foot snow loads and fifteen (15) pound wind loads when imposed from the mobilehome.

d. The mobilehome shall be installed in accordance with the installation instructions provided by:

The manufacturer of the mobilehome; or

A California-licensed architect or engineer when the manufacturer instructions are not available.

B. Utility connections shall be made permanent as they are required for conventional buildings; no shut off of any type shall be under the mobilehome.

15.44.150 - Surrender of registration.

Prior to occupancy, all building permits shall be obtained by owner or contractor. The owner shall request a certification from the department of public works that a certificate of occupancy be issued pursuant to Section 18511(b)(2) of the California Health and Safety Code. Thereafter, any vehicle license plate, certificate of ownership, and certificate of registration issued by a state agency is to be surrendered to the appropriate state agencies prior to occupancy. Any mobilehome which is permanently attached with underpinning or foundation to the ground must bear a California insignia or federal label, pursuant to Section 18550(b) of the Health and Safety Code.

15.44.160 - Mobilehome taxation.

Mobilehomes placed on a permanent foundation in compliance with all regulations become exempt from vehicle license fees and become subject to property tax laws.
