Duarte Municipal Code Ch. 15.08 Explosives

As used in this chapter, the term "person" shall mean any individual, firm, copartnership, joint adventure, association, social club, fraternal organization, corporation, estate, trust, business trust, receiver, syndicate, city, or any other group or combination acting as a unit, and the plural as well as the singular number.

Pursuant to Government Code Section 51178, the City hereby designates the Fire Hazard Severity Zones as recommended by the California Department of Forestry and Fire Protection. The map entitled "City of Duarte Fire Hazard Severity Zones" designates these zones and is hereby incorporated by reference. This map is retained on file at the City and at the Office of the State Fire Marshal.

As used in this chapter, the term "residential street" means any public street, or section of a public street, located within any portion of the city which is zoned R-1, R-2, R-3, or located within any other zone classification which limits the use of any portion of the city to residential purposes.

Any combination of vehicular units receiving their motive power from a single engine or power source shall be considered one "vehicle" for the purposes of this chapter.

It is a misdemeanor for any person to drive upon any residential street in the city any vehicle containing therein or thereon more than fifty pounds of explosives.

It is a misdemeanor for the owner, or authorized agent of the owner, of any vehicle to permit the driving of the vehicle, while the vehicle contains therein or thereon more than fifty pounds of explosives, upon any residential street in the city.

Any person violating or permitting or responsible for the violating of any of the provisions of this chapter shall be guilty of a misdemeanor, and upon conviction thereof shall be punished as provided in Section 1.04.100 of this code.
