2.12.010 Office of city administrator/¶
chief fiScal officer created. The office and position of the city adminis- trator/chief fiscal officer of the city is created and established. The positions may be full- time or part-time and filled by contracted management services or by exempt city em- ployee as may from time to time be decided by the city council. The city administra- tor/chief fiscal officer shall be appointed by the city council wholly on the basis of his or her administrative and executive ability, suit- ability and qualifications and shall hold office for and at the will of the city council. 2.12.020 Eligibility.¶
No member of the city council shall be eligible for appointment as the city adminis- trator until one year has elapsed after the council member has ceased to be a member 11 of the city council. (Ord. 197 § 2, 1999; Ord. 188 § 2, 1996)
2.12.030 Bond.¶
The city administrator and acting city ad- ministrator, if any, shall establish a corporate surety bond to be approved by the city coun- cil in such sum as may be determined by the city council, and shall be conditioned upon faithful performance of the duties imposed upon the city administrator or acting city ad- ministrator as prescribed in this chapter. Any premium for such bond shall be a proper charge against the city. (Ord. 197 § 3, 1999; Ord. 188 § 3, 1996)
2.12.040 Acting city administrator.¶
The city administrator may appoint a qualified city employee to serve as adminis- trator pro tempore during any temporary ab- sence or disability of the city administrator with the approval of the city council. It shall be the responsibility of the city administrator pro tempore, during the disability or the tem- porary absence to attend all meetings of the city council and the planning commission unless excused by the mayor, the council or the planning commission. 2.12.050 Compensation.¶
A. The city administrator shall receive such compensation as the city council shall from time to time determine. B. In addition the city administrator shall be reimbursed for all actual and necessary expenses incurred by him or her in the per- formance of his or her official duties subject to prior council approval.
;/ C. On termination of services/ employ- ment of the city administrator by reason of involuntary removal from service other than wilful misconduct in office, the city adminis- trator may receive cash severance payment in a lump sum, if any, to be determined at the sole discretion of the city council. The city council reserves the right not to award any severance pay. D. The city council may from time to time adjust the city administrator's compen- sation based upon performance, particularly the securing and administering grants for the benefit of the city. 2.12.060 Power and duties generally.¶
The city administrator shall be the head of the government under the direction and con- trol of the city council except as otherwise provided in this chapter. He or she shall be responsible for the efficient administration of all the affairs of the city which are under his or her control. In addition to his or her gen- eral powers as administrative head, and not as a limitation thereon, it shall be his or her duty and he or she shall have the powers set forth in Section 2.12.070. 2.12.070 Specific dnties.¶
A. Law Enforcement. It shall be the duty of the city administrator and he or she shall be responsible to enforce the ordinances of the city and to see that all franchises, con- tracts, permits and privileges granted by the city council are faithfully observed and per- formed. B. Authority over Employees. It shall be the duty of the city administrator and he or 12 she shall have authority to control, order and give direction to all heads of departments and to, through the department heads, subordinate officers and employees of the city under his or her jurisdiction. C. Power of Appointment and Removal. It shall be the duty of the city administrator to appoint, remove, promote and demote any or all officers and employees of the city, with the following limitations. Such appointments, promotions, demolitions or dismissal shall be subject to prior approval of the city council and shall conform to all applicable personnel ordinances rules and procedures. The city administrator shall have no authority with respect to tenure of the city attorney, fire chief and chief of police and his or her offi- cers, all of whom serve at the will of the city council. The city administrator has no author- ity over any elected official. D. Administrative Reorganization of the Offices. It shall be the duty and responsibility of the city administrator to conduct studies and effect such administrative reorganization of the offices, and positions under his or her direction as may be indicated in the interest of efficient, effective and economical conduct of the city's business subject to the prior ap- proval of the city council. E. Ordinances. It shall be the responsibil- ity of the city administrator to recommend and prepare for the city council for adoption such resolutions, measures and ordinances as he or she deems necessary in cooperation with the city attorney and Small Cities Organized Risk Effort. F. Attendance at Meetings. It shall be the responsibility of the city administrator to at- tend all meetings of the city council and the planning commission unless, at his or her
) / request he or she is excused therefrom by the mayor individually or the city council or the planning commission. In the event of disabil- ity or temporary absence of the city adminis- trator, the pro tempore city administrator may take his or her place. G. Financial Reports. It shall be the duty and responsibility of the city administrator to keep the city council at all times fully advised as to the financial condition and needs of the city in accordance with all state and federal laws and to provide timely financial reports to the city council. H. Budget. It shall be the duty and re- sponsibility of the city administrator to pre- pare and submit the proposed annual budget to the city council in a timely manner and to publish and administer the adopted final an- nual budget according to all applicable gov- ernment codes. I. Contracts, Franchises and Agreements. The city administrator shall design, prepare and execute in the name of the city council and for the city any contracts, franchises or agreements authorized and approved by the city council unless the city council shall ex- pressly provide for other manner of execution of such contracts, franchises or agreements. J. Expenditure Control and Purchasing. It shall be the duty of the city administrator to see that all expenditures be submitted to the city council for approval, after review and recommendation of the city administrator, or the city employee to whom the city adminis- trator has delegated this responsibility. The city administrator shall be responsible for the purchase of all equipment and supplies for all department or divisions of the city under his or her control. Before authorizing any pur- chase over two hundred dollars, the city ad- 13 ministrator shall seek council approval. All expenditures must be made within the budg- etary limitations. K. Investigation and Complaints. It shall be the responsibility of the city administrator to make investigations into the affairs of the city and any department or division under his or her control thereof and any contract for the proper performance of an obligation to the city. Further it shall be the duty of the city administrator to investigate all complaints in relation to the matters concerning the admini- stration of the city government and in regard to the services maintained by public utilities in the city. L. Personnel Policy. It shall be the re- sponsibility of the city administrator to pre- pare and maintain the city's personnel poli- cies and procedures and prepare the job and position descriptions, appointment, removal and promotion and compensation schedules for all positions and employees of the city for approval by the city council. M. Public Buildings. It shall be the re- sponsibility of the city administrator to exer- cise general supervisions and maintenance over all the public buildings, public parks and all other public property which are under the control and jurisdiction of the city council. N. Community and Economic Develop- ment. It shall be the duty and responsibility of the city administrator to develop, establish and administer community and economic development programs and grants. 0. Risk Management. It shall be the re- sponsibility of the city administrator to inven- tory the assets of the city and develop and implement a risk management plan in coop- eration with SCORE.
P. Additional Duties. It shall be the duty of the city administrator to perform such other duties and exercise such other powers as may be delegated to him or her from time to time by ordinance or resolution or other official action of the city council. (Ord. 197 § 7, 1999; Ord. 188 § 7, 1996)
2.12.080 Internal relations.¶
A. Council-Administrator Relations. The city council and its members shall deal with the administrative services of the city through the city administrator except for purpose of inquiry and neither the city council nor any of its members thereof shall give orders or in- structions to any subordinate of the city ad- ministrator. The city administrator shall take his orders and instructions from the City Council only when sitting in a duly convened meeting of the City Council and no individual Council member shall give orders or instruc- tions to the City Administrator. B. Departmental Cooperation. It shall be the duty of all subordinate officers, elected officials, city attorney and law enforcement to assist the city administrator in administer- ing the affairs of the city efficiently, eco- nomically and harmoniously. C. Attendant Commission Meetings. The city administrator may attend any or all meetings of commissions, boards and committees created by the city council upon the administrator's own volition or upon di- rection from the city council. At such meet- ings which the city administrator attends, the administrator shall be heard by such bodies as to all matters upon which he or she wishes to address the members thereof and the adminis- trator shall inform the members as to the status of any matter being considered by the 14 city council, and he or she shall cooperate to the fullest extent with the members of all commissions, boards or committees ap- pointed by the city council. 2.12.090 Limitations.¶
Nothing in this chapter shall be construed as a limitation on the power or authority of the city council to enter into any supplemen- tal agreement with the city administrator de- lineating additional terms and conditions of employment not inconsistent with the provi- sions of this chapter.
