Chapter 17.88 — ZONING ORDINANCE AMENDMENTS

§ 17.88.010. Purpose.

Amendments to the provisions of this Zoning Ordinance may be made by the Council for the public health, safety, convenience, general welfare and the aesthetic harmony of the City. (Prior code § 159.42.010)

§ 17.88.020. Hearings and notice.

Upon receipt in proper form of a Zoning Ordinance amendment application, or at the direction of the Council, and following Department review, hearings shall be set before the Commission and Council. Notice of the hearings shall be given pursuant to the requirements of Chapter 17.104 (Hearings and Appeals).

§ 17.88.030. Commission action on amendments.

  • A. The Commission shall make a written recommendation on the proposed amendment whether to approve, approve in modified form or disapprove, based upon the findings contained in Section 17.88.050 .

  • B. Commission action recommending that the proposed Zoning Ordinance amendment be approved, approved in modified form, or denied shall be considered by the Council following Commission action.

§ 17.88.040. Council action on amendments.

Upon receipt of the Commission’s recommendations, the Council may approve, approve with modifications, or disapprove the proposed amendment based upon the findings contained in Section 17.88.050 . Amendments to the Zoning Ordinance shall be adopted by ordinance. (Prior code § 159.42.040)

§ 17.88.050. Findings.

An amendment to this Zoning Ordinance may be adopted only if the following findings are made:

  • A. The proposed amendment is consistent with the General Plan;

  • B. The amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City.
