5.68.010 - Definitions.

Except where the context otherwise requires, the definitions given in this section govern the construction of this chapter:

A. "Fee" means the consideration charged, whether or not received, for the use of the facility, whether to be received in money, goods, labor or otherwise, including all receipts, cash, credits and property and services of any kind or nature.

B. "Person" means any individual, firm, partnership, joint venture, association, social club, fraternal organization, joint stock company, corporation, estate, trust, business trust, receiver, trustee, syndicate or any other group or combination acting as a unit.

C. "Self-service car wash" means any establishment or facility wherein a person, for a fee, may have the right to wash, clean, wax, or dry his motor vehicle or do any combination thereof, and which is open and available to the general public.

5.68.020 - Permit required.

It shall be unlawful to establish or operate any self-service car wash in the city without first having secured a permit therefor as provided in this chapter. Applications for such permits shall comply with the general provisions relating to applications for licenses and permits.

5.68.030 - Permit application.

To obtain a self-service car wash permit, the applicant shall file a written application therefor with the director of finance. Such application shall set forth the following:

A. The name, age and address of the applicant, or in the case of partners, the names, ages and residences of every person involved, or if a corporation, its name, date and place of incorporation, address of its principal place of business and names and addresses of all its officers;

B. Whether an application for a similar permit has been refused, canceled, rescinded, revoked or suspended by any city, county or political subdivision of the state;

C. The address at which the proposed business is to be conducted.

Accompanying the application shall be a full set of plans and specifications showing ground site, lot drainage, area dedicated to the washing of cars, estimated annual water consumption, buildings and such signs, with their elevations, as are proposed to be constructed and operated.

5.68.040 - Permit fee.

The application for a self-service car wash permit shall be accompanied by a nonrefundable fee fixed by resolution of the city council, which shall be in addition to any business license fees otherwise required to be paid. Each self-service car wash permit issued pursuant to this chapter must be renewed yearly, unless sooner revoked. An unrevoked permit may be renewed on a yearly basis on written application to the director of finance at least thirty days before its expiration date. Each renewal application shall include all changes in and updating of information previously furnished under Section 5.68.030 of this chapter, and shall be accompanied by a nonrefundable renewal fee as fixed by resolution of the city council.

5.68.050 - Hours of business.

A. It shall be unlawful to keep any such establishment open for business between the hours of eleven p.m. and six a.m. the following day. Hours of business of any such establishment shall be posted in a conspicuous place.

B. It shall be unlawful to keep any such establishment open for business between the hours of eleven a.m. and four p.m. unless there is an adult attendant continuously in charge of the premises during such hours, except on Sunday.

C. No person shall establish, operate or maintain, or cause to be established, operated or maintained, any self-service car wash unless the same shall conform to the following requirements:

  1. Between the hours of eleven p.m. and six a.m. the following day, on all sides not contiguous to a building or other barrier, the lot shall be surrounded by a metal chain or by a fence or barricade approved by the police department;

  2. Any chain so installed shall be of standard metal links. The metal shall be not less than three-sixteenths inch in diameter. The chain shall run through or be securely attached to substantial posts of metal, concrete or wood, embedded in the ground with concrete and placed at such intervals from one another as to adequately support the chain. The height of the chain shall not be less than eighteen inches nor more than thirty-six inches above the ground level. Between the hours of eleven p.m. and six a.m. the following day, said metal chain so installed shall be locked with a suitable padlock.

5.68.060 - Time for compliance.

All self-service car washes now licensed shall be given thirty days from the effective date of the ordinance codified in this chapter to conform to the terms of this chapter.
