5.64.010 - Public dance defined.

A public dance within the meaning of this chapter is any dance to which the public is admitted and which is held and conducted for profit, or at which an admission fee is charged for persons attending the dance, whether such admission fee is charged at the door or through the sale of tickets, or in any other manner whatsoever; or any dance conducted at any place where intoxicating beverages are sold, whether such dance is conducted within the room in which such intoxicating beverage is sold, or in any other room connected therewith.

5.64.020 - Permit—Required.

No person shall conduct, carry on or participate in the conducting or carrying on of any public dance in the city without procuring a permit for that purpose from the city council.

5.64.030 - Permit—Application.

An application for a permit to conduct a public dance as required by this chapter shall be in writing and shall set forth the name of the applicant; the time and the place where it is proposed to hold or conduct a public dance; and whether or not alcoholic beverages are sold on such premises. If the application is for the conduct of a public dance in any place where intoxicating beverages are sold, the application shall contain the name or names of the licensee under the Alcoholic Beverage Control Act of the state.

5.64.040 - Permit—Fee.

A nonrefundable permit fee, to be established by resolution of the city council, shall be paid at the time as application for a permit to conduct a public dance under this chapter is made. This nonrefundable permit fee shall be paid annually.

5.64.050 - Permit—Nontransferable.

No permit issued pursuant to this chapter for the conduct of a public dance shall be assignable or transferable.

5.64.060 - Permit—Revocation.

Any permit required by this chapter issued for the conduct of a public dance may be revoked at any time by the city for violation of law or for revocation of an Alcoholic Beverage Control License or for any violation of any provisions of this chapter or any other applicable statute, law or ordinance.

5.64.070 - Exempt organizations.

Nothing contained in this chapter shall be construed to require the payment of a permit fee by foundations, organizations or corporations organized and operated for religious, labor, fraternal, educational or charitable purposes, not conducted for profit and in which no part of the net earnings or admission fee to any public dance inures to the benefit of any private shareholder or individual. All persons claiming this exemption shall file a sworn statement on the form prescribed by the city, stating the grounds on which such exemption is claimed.

5.64.080 - Closing hours.

All dancing at any public dance shall cease immediately at one a.m. of any day except Sunday, in which event all dancing at any public dance shall cease immediately at twelve midnight.

5.64.090 - Illumination of dancing place.

No public dance shall be conducted in any place which is not continuously well illuminated.

5.64.100 - Restriction as to minors.

No minor shall be permitted to dance in any place where intoxicating beverages are regularly sold.

5.64.110 - Prohibited activities.

No person holding a permit to conduct a public dance pursuant to this chapter shall permit any loud noise or rude conduct within the place where dancing is conducted.
