5.39.010 - Definition.¶
Cabarets are defined as any business wherein there is either live entertainment and/or live music, including music played by a disc jockey or karaoke, and which is subject to the jurisdiction of the Alcoholic Beverage Control Board, including restaurants selling liquor and providing entertainment.

5.39.020 - License—Council approval required when.¶
When application is made to the city council for a cabaret license, the city council shall consider the character of the applicant, applicant's qualifications to carry on the business in question, and the effect of such business on the health and welfare of the citizens of Daly City. The decision of the city council shall be final. A cabaret license shall not be issued until the application for such license has been considered by the city council pursuant to this section and the city council has authorized the director of finance to issue such license.

5.39.030 - Conditions of license.¶
Cabarets shall be subject to the following conditions, including any conditions imposed by the city council on the applicant only:
A. Any and all live entertainment or music shall end at one a.m.;
B. A cabaret shall close not later than two a.m.;
C. No dancing is allowed without a dance permit pursuant to the provisions of Chapter 5.64;
D. If the cabaret has music or entertainment, or both, security officers shall be hired and be on duty, in uniform, from the scheduled time for entertainment or music to begin until the close of the cabaret.

5.39.040 - Variance.¶
Any applicant for a license as set forth in this section shall have the right to request a variance from the application of this chapter and/or any conditions adopted by the city council at any time, by a written request filed with the city council.

5.39.050 - Term of license.¶
The license required under Section 5.39.020 shall be issued on a yearly basis and must be renewed yearly to remain in full force and effect. Said license shall terminate upon the sale or transfer of the ownership of the business, or, the sale or transfer of thirty percent or more of the common stock ownership of a corporation. In the event of such termination, the new owner, transferee or shareholder(s) shall be required to make a new application for said special license.
