Corte Madera Municipal Code Ch. 17.04 General Provisions

This title may be referred to as "The Subdivision Ordinance of the Town of Corte Madera."

This title is adopted to regulate the subdivision of land and to require the provision of certain prescribed improvements which are needed as a consequence of the subdivision of land, and in order that the following purposes shall be achieved:

(1) To implement the town of Corte Madera general plan adopted by the town council on June 3, 1963, as a long range, general, comprehensive guide to the physical development of the town;

(2) To provide lots of sufficient size and appropriate design for the purposes for which they are to be used;

(3) To provide streets of adequate capacity for the anticipated traffic which will utilize them and to ensure that they are designed so as to minimize safety hazards to vehicles and pedestrians;

(4) To provide sidewalks and pedestrianways where needed for the safety and convenience of pedestrians;

(5) To preserve the natural assets of the town's setting, to prevent the indiscriminate clearing of property and the destruction of trees and shrubs, to prevent excessive and unsightly grading of hillsides, to ensure adequate access to each building site, and to create new beauty through skilled subdivision design;

(6) To provide for water supply, sanitary sewerage, storm drainage, street lighting and other utilities needed for the public health, safety and convenience;

(7) To provide recreation areas and other types of public areas where needed to serve new developments;

(8) To ensure that the costs of providing rights-of-way and improvements for vehicular and pedestrian movement, utilities and public areas needed to serve new developments are borne by the subdivider rather than by the property owners of the town at large;

(9) To ensure that, insofar as possible, land is subdivided in a manner which will promote the public health, safety, convenience and general welfare.

A subdivision map shall conform with the principles and standards of the general plan with respect to population densities and distribution, locations and sizes of public areas and rights-of-way and improvements of major streets, secondary streets, collector streets and minor streets. In the absence of a precise plan, a major street or a secondary street shall conform approximately with the alignment shown on the general plan.

A subdivision map shall conform with precise plans for streets, public areas and other projects adopted by the town council. A subdivision map shall conform with official plan lines for the widening of streets and for other projects.

A subdivision map shall conform with the Zoning Ordinance of the town, hereinafter referred to as Title 18, with respect to uses of land, lot sizes and dimensions, space for off-street parking and off-street loading areas and other applicable regulations.

The provisions of this title are supplemental to the provisions of the Subdivision Map Act of the state.

The town planning commission, hereinafter referred to as the planning commission, of the town of Corte Madera, hereinafter referred to as the town, is hereby designated as the advisory agency, with respect to subdivisions, as provided in the Subdivision Map Act of the state, and shall have all the powers and duties with respect to preliminary, tentative and final maps and the procedures relating thereto which are described by law and by this title.
