§ 30-16. BUFFER ZONE (B).

§ 30-16.1. Purpose (B).

The Buffer Zone (B) is established to provide physical separation between conflicting land uses.

§ 30-16.2. Uses (B).

  • a. Principal Permitted Uses. The following uses shall be permitted in the Buffer Zone (B):

    1. Employee recreation;

    2. Fences, walls, or hedges not to exceed a height above the ground level of six feet, unless approved by the Architectural Review Board;

  1. Landscaping;

  2. Motor vehicle parking; and

  3. Railroad tracks and railroad spur tracks.

  4. Indoor marijuana cultivation is allowed consistent with State law which permits no more than six live marijuana plants to be planted, cultivated, harvested, dried, or processed within a single private residence or inside an accessory structure located upon the grounds of a private residence that is fully enclosed and secured as long as the marijuana cultivation activities comply with the regulations set forth in paragraph c of subsection 9-24.4 .

§ 30-16.3. Prohibited Uses (B).

The following uses and buildings shall be prohibited in the Buffer Zone (B):

  • a. Buildings, structures, and the storage of materials, equipment, and vehicles shall be prohibited in the Buffer Zone (B).

  • b. Commercial marijuana uses, except as permitted by subsection 9-24.4 .

  • c. Marijuana cultivation outdoors upon the grounds of a private residence.

  • d. Marijuana cultivation indoors that does not comply with Section 30-16.2a .
