Chapter 5.62 — BODY ART ESTABLISHMENTS

5.62.010 - Definitions.

Any terms used in this chapter which are defined in Chapter 11.36 of the Los Angeles County Code shall have the meaning set forth in that section.

5.62.020 - Permitted zones.

Subject to the provisions of this chapter, body art establishments shall be permitted only in the commercial (C-2) and light and heavy manufacturing (M-1 and M-2) zones, as defined by this title.

5.62.030 - Permit requirement.

(a)

Every person owning a body art establishment shall, within six months of the effective date of the ordinance codified in this chapter, obtain a public health facility permit pursuant to the provisions of Article 3 of Chapter 11.36 of the Los Angeles County Code.

(b)

Every person conducting body art activity shall, within six months of the effective date of this chapter, obtain a public health operator permit pursuant to the provisions of Article 3 of Chapter 11.36 of the Los Angeles County Code.

5.62.040 - Location requirement.

(a)

Body art establishments shall not be located within one thousand five hundred feet of any:

(1)

Lot upon which there is located any residence or any property located in a residential or agricultural zone, or equivalent zone in any other jurisdiction; and

(2)

Church, chapel or other publicly recognized place of worship; and

(3)

Public or private school (kindergarten through twelfth grade) or child care center; and

(4)

Any boys' club, girls' club, or similar youth organization; and

(5)

Park owned by a public entity; and

(6)

Any other establishment permitted/licensed by the city of Commerce or county of Los Angeles as a body art establishment.

(b)

The distances specified in this section shall be measured in a straight line, without regard to intervening structures, from the nearest point of the premises in which the proposed body art establishment is to be established to the nearest property line of a use or zoning classification listed in this section.
