5.36.010 - Definition—Public billiard room.¶
"Public billiard room" means any place open to the public where billiards, bagatelle or pool is played, or in which any billiard, bagatelle or pool table is kept and persons are permitted to play or do play thereon, whether any compensation or reward is charged for the use of such table or not. Public billiard room does not include a place having not more than one coin-operated pool or billiard table, which table is maintained as an incident to some other type of business or activity.

5.36.020 - Public billiard room—License required.¶
Every person managing or conducting a public billiard room shall first procure a license and pay an annual license fee of:
(a)
One hundred thirty-five dollars for the first year;
(b)
Fifty-four dollars for each annual renewal.

5.36.030 - Application.¶
Any person desiring to obtain a license to conduct, manage or carry on a public billiard room shall file with the license collector by a written application therefor, signed by the applicant or an officer thereof if the applicant is a corporation, stating the exact location of the place where such public billiard room is to be located, and shall pay the required fee to the license collector.

5.36.040 - Investigation by license collector.¶
The license collector shall make all investigation necessary in order to determine whether in his opinion the applicant is of sufficiently good moral character or is a sufficiently fit person to manage or conduct such establishment, and whether by reason of the place where such establishment is to be located the conducting or carrying on thereof would be detrimental to the public health, public order or public morals.

5.36.050 - Recommendation.¶
If the license collector finds that the applicant for a license for a billiard room is not of good moral character or is an unfit person to manage or conduct such establishment, or that by reason of the place where such establishment is to be located the conducting or carrying on thereof would be detrimental to the public health, the public order or the public morals, he shall notify the applicant in writing of his refusal to issue the license.

5.36.060 - Hearing on refusal.¶
If an applicant for a license for a billiard room, who has been notified of the disapproval thereof by the license collector, within fifteen days after such notification requests a hearing, such hearing shall be held in accordance with the provisions of Section 5.04.290.

5.36.070 - Location, transfer.¶
Any license issued to conduct a public billiard room shall authorize such public billiard room to be conducted only at the place described in the application and by the person by whom such application is made, except that the license collector may authorize a transfer of such license from one place to another.

5.36.080 - Hours.¶
No owner, manager, proprietor or other person having charge of any public billiard room shall keep the same open or allow or permit the same to be kept open or allow or permit any game to be played therein from two a.m. until six a.m. of any day or allow or permit any person except such owner, manager, proprietor or person in charge thereof, or the employees regularly employed in and about the same, to be or remain therein between the hours aforesaid.

5.36.090 - Disorderly persons.¶
No owner, manager, proprietor or other person in charge of any public billiard room shall allow or permit any intoxicated, quarreling or disorderly person or persons to be or remain in such place.

5.36.100 - Minors—Admission.¶
No owner, manager, proprietor or other person in charge of any public billiard room shall allow or permit any person under the age of eighteen years to be, remain in, enter or visit such place unless such minor person is accompanied by one of his parents or by his guardian, or such parent or guardian personally presents
written consent to the owner, manager, proprietor or other such person in charge. The written consent shall be in the manner and form approved by the license collector.

5.36.110 - Minors under eighteen.¶
A person under the age of eighteen years shall not be, remain in, enter or visit any public billiard room unless such minor is accompanied by one of his parents, or by his guardian, or has the said written permission of his parent or guardian. The written consent shall be in the manner and form approved by the license collector.

5.36.120 - Rules and regulations.¶
The license collector may adopt such rules and regulations as he finds are necessary and expedient to enforce the provisions of this chapter.

5.36.130 - Visibility of interior.¶
A person shall not maintain any public billiard room, or similar place of business containing billiard or pool tables to which the public is invited, unless the entire interior of such public billiard room or similar business, except rest rooms, is visible from the entrance to the premises of which said public billiard room or similar business is a part.
