Sec. 2-1.201. - Authority.¶
The provisions of this article are enacted pursuant to the provisions of Section 36516 of the Government Code of the State, authorizing the Council to provide by ordinance that each member of the Council shall receive a prescribed salary, the amount of which shall be based upon the population of the City as determined by the last preceding Federal census or a subsequent census, or the estimate validated by the Department of Finance of the State of California.

Sec. 2-1.202. - Estimate of population.¶
The latest estimate of population of the City, by the Department of Finance is 8,929 as of January 1, 1992.

Sec. 2-1.203. - Payment.¶
Each member of the Council shall receive as a salary the sum of four hundred and fifty dollars ($450.00) per month, which salary shall be payable at the time and in the same manner as salaries are paid to other officers and employees of the City.
In addition, any amounts paid by the City for retirement, health and welfare, and Federal Social Security benefits shall not be included for purposes of determining salary under this section provided the same benefits are available and paid by the City for its employees.
The salary under this section is subject to the terms and conditions of Section 2-1.204, increases and decreases.

Sec. 2-1.204. - Increases and decreases.¶
The salary as outlined in Section 2-1.203 shall be amended automatically provided one of the following conditions is met:
(a) Following any new and later estimate of population as made by the Federal Census or an estimate validated by the Department of Finance of the State of California which places the City in any other population group as outlined in Section 36516 subsection A of the Government Code.
The salary payable to each member of the Council shall be increased or decreased accordingly to equal the limit prescribed in Section 36516 subsection A of the Government Code of the State.
(b) Should Section 36516 subsection A of the Government Code be amended either as to the definition of population categories or as to the amount of salary prescribed for each population category, the salary payable to each member shall be increased or deceased accordingly to equal the limit prescribed in Section 36516 subsection A as amended.
However, any salary so increased or decreased under either of the above conditions does not apply to a councilman during his term of office; however, the prohibition herein expressed shall not prevent the adjustment of the compensation of all members of a council serving staggered terms whenever one or more members of such council becomes eligible for a salary increase by virtue of his beginning a new term of office.

Sec. 2-1.205. - Reimbursement for expenses.¶
The salaries set forth in this article are and shall be exclusive of any amount payable to each member of the Council as reimbursement for actual and necessary expenses incurred by him in the performance of official duties for the City.

Sec. 2-1.206. - Constitutional provisions suspended.¶
The salaries set forth in Section 2-1.203 of this article shall be payable from and after August 1, 1968, in accordance with the determination of the Attorney General of the State in Opinion 64-278, dated April 28, 1966, that a state of war exists within the meaning of Section 5 of Article XI of the Constitution of the State and Sections 53070 and 53071 of the Government Code of the State, pursuant to which any prohibition against an increase in compensation during the term of any elective officer is suspended.
