Clearlake Municipal Code § 8-4 Off-Street Parking Facilities

Pursuant to California Vehicle Code Section 21107.8, the City Council of the City of Clearlake hereby extends the applicability of the following Vehicle Code Sections to certain privately owned and maintained off-street parking facilities located within the City; a. Vehicle Code Section 22507.8 (Parking in Handicapped Space by Non-Handicapped Person). b. Vehicle Code Section 22350 (Speeding). c. Vehicle Code Section 23103 (Reckless Driving). d. Vehicle Code Section 23109 (Speed Contests). e. Division 16.5 of the Vehicle Code (Regulation of Off-Road Vehicles). (Ord. #30, S1)

The City Council shall designate by resolution each such privately owned and maintained off-street parking facility to which this section shall apply. No such resolution shall be adopted without a public hearing thereon and ten (10) days prior written notice to both the owner and operator of each facility involved. (Ord. #30, S2)

This section shall not apply to any off-street parking facility unless the owner or operator has posted in a conspicuous place at each entrance to such off-street parking facility a sign not less than seventeen inches by twenty-two inches (17" × 22") in size with lettering not less than one (1") inch in height, stating the following notice: STATE TRAFFIC LAWS ENFORCED HERE City Ordinance No. 30 (Ord. #30, S3)

The penalty for violation of any of the Vehicle Code Section set forth above shall be those prescribed by the Vehicle Code relating to the sections. (Ord. #30, S4)
