Sec. 2-31. - Voting by council.

(a) If action by the city council is a tie vote on any matter arising out of environmental protection, planning and land development ordinances under this Code, whether or not the matter is before the city council on appeal, the city council may, following the tie vote and in advance of adjournment of the meeting during which the tie vote occurred, continue the matter for further consideration and determination to a time and date certain not later than 30 calendar days following the date on which the tie vote occurred.

(b) If the matter is not continued for further consideration and determination in the manner specified in subsection (a) of this section, such tie vote shall be deemed to constitute a denial or disapproval effective on the date the tie vote occurs of the matter for which application is made (and, in an appeal, denial of the action requested by the application, as distinguished from denial of the appeal), and such action shall be deemed to be final and not subject to reconsideration pursuant to the application upon which the vote was taken.

(c) If, during the meeting to which consideration and determination is continued pursuant to this section, another tie vote occurs, the application shall, effective on the date of such continued meeting, be deemed denied in the manner prescribed in this section, and the action shall be deemed to be final in the manner prescribed in this section. During the meeting to which consideration and determination is continued pursuant to this section, no new or additional evidence shall be received or considered unless any public hearing required by law has been reopened and any notice thereof required by law has been given.

Sec. 2-32. - Compensation.

In accordance with Government Code § 36516, the compensation of the members of the city council shall be $1,900.00 per month, each, payable monthly.

Sec. 2-33. - Filing fee for candidate nominations and municipal elections.

The city clerk shall collect a filing fee in the amount of $25.00 at the time a candidate's nomination papers are filed.

Sec. 2-34. - City council by-district electoral system.

Pursuant to Government Code § 34886 and the schedule established in section 2-36 of this chapter, commencing with the November 2020 general municipal election, each member of the Citrus Heights City Council shall be elected by district in five single-member districts. Each councilmember shall serve a term of four years. The city's by-district electoral system shall be conducted in accordance with California Government Code § 34871(a).

Sec. 2-35. - Establishment of city council electoral districts.

(a) Pursuant to section 2-34 of this chapter and beginning with the general municipal election in November 2020, the members of the city council from districts 1 and 3 shall be elected on a by-district basis as that term is defined in Government Code § 34871(a).

(b) Pursuant to section 2-34 of this chapter and beginning with the general municipal election in November 2022, the members of the city council from districts 2, 4, and 5 shall be elected on a by-district basis as that term is defined in Government Code § 34871(a).

(c) Except as provided in subsection (d) hereof, all candidates for the City Council and all appointed and elected councilmembers shall fully comply with applicable law including but not limited to Government Code § 34882 and Elections Code § 10227. Termination of residency in a district by a councilmember shall create an immediate vacancy for that council district unless a substitute residence within the district is established within 30 days after the termination of residency.

(d) Notwithstanding any other provision of this section, each of the councilmembers in office at the time this chapter takes effect shall continue in office until the expiration of the full term to which he or she was elected and until his or her successor is qualified. Vacancies in councilmember offices elected at-large may be filled from the city at-large. At the end of the term of each councilmember, that member's successor shall be elected on a by-district basis in the districts established in subsection A hereof and as subsequently reapportioned as provided by law. A vacancy in a councilmember office elected by-district shall be filled by a person qualified to hold the office, consistent with applicable law.

Sec. 2-36. - Election schedule for councilmembers elected by-district.

(a) Consistent with section 2-35, Councilmembers from council districts 1 and 3 shall be elected beginning at the general municipal election in November 2020, and every four years thereafter, as such council districts may be amended from time to time.

(b) Consistent with section 2-35 the councilmembers from council districts 2, 4, and 5 shall be elected beginning at the general municipal election in November 2022, and every four years thereafter, as such council districts may be amended from time to time, consistent with applicable law.

Sec. 2-37. - Map of council districts.

The city clerk shall maintain a map of the city showing the current boundaries and numbers of each city council district as they are established and may be amended from time to time by ordinance of the city council. The map is attached hereto as Exhibit A and incorporated herein.
