12.28.010 - Area designated—Regulations applicable.¶
All that certain area situated approximately four miles east of the city on Berenda Slough, as designated in that certain agreement dated July 21, 1964, and revised accordingly between the city and the Chowchilla Water District pertaining to the use of such area as a recreational area by the city, is hereby declared a city park within the meaning of Chapter 8, Part 2, Division 3 of Title 4 of the Government Code of the state, and shall henceforth be known and designated as "Berenda Reservoir and Recreational Park" and shall be used by the general public in accordance with this chapter, the applicable provisions of the Harbors and Navigation Code of the state and regulations thereunder, other applicable laws of the state, and rules and regulations adopted by the city council pursuant to this chapter.

12.28.020 - Rules and regulations—Council authority.¶
The city council shall, from time to time, adopt rules and regulations by resolution pertaining to the area open to the general public and the hours of use and such other regulations as they deem advisable for the health and safety of persons using the facilities of such area. It is unlawful for any person to violate any such rule or regulation duly adopted pursuant to this section. In absence of resolution policy the same provisions that apply to all city parks will be enforced. Authority is further subject to the joint powers agreement by and between the city of Chowchilla and the county of Madera as it relates to enforcement powers.

12.28.030 - Motor vehicle operation restrictions.¶
No person shall drive a motor vehicle within the confines of the Berenda Reservoir and Recreational Park at a speed greater than fifteen miles per hour and only on roads or upon areas designated for vehicular travel; provided, however, that notwithstanding the foregoing, no person shall operate a motor vehicle at a speed which endangers the safety of persons or property.

12.28.040 - Motorboat operation—Restrictions generally.¶
No person shall operate any motorboat which includes but is not limited to motor powered boats, jet skis or similar water going vessels, upon the water within the Berenda Reservoir and Recreational Park except as set forth by resolution of the city of Chowchilla, as now or hereafter amended.

12.28.050 - Motorboat operation—Operator to signal when water skier falls.¶
The operator of any motorboat pulling a skier, aquaplane or other similar device, or the observer in such motorboat shall, when the skier falls or is otherwise down in the water, signal other motorboats of such fact by raising an arm sufficient to be visible to other boats in the area, and all other motorboats shall yield the right-of-way to such downed skier.

12.28.060 - Swimming permitted in designated areas only.¶
No person shall swim in any areas except those designated by posting as approved by the city council specifically for swimming. For the purposes of this section, swimming is defined as including but not limited to swimming, wading, standing, entering, or the placing of any objects, person, animal, materials or plants in the water.

12.28.070 - Seaplanes prohibited.¶
It shall be unlawful to land or take off from the surface of the lake in the Berenda Reservoir and Recreational Park any seaplane or any other airplane equipped to land and take off from water without city permit.

12.28.080 - Intoxicating beverages—Sale prohibited.¶

12.28.090 - Possession and consumption of alcohol beverages.¶
No persons shall possess or consume any intoxicating beverage within the confines of the Berenda Reservoir and Recreational Park without city permit. See Section 12.24.040.

12.28.100 - Firearms prohibited—Exception.¶
No person shall carry, shoot or discharge any type of firearm within the Berenda Reservoir and Recreational Park. The term "firearm" as used in this section shall include a pistol, rifle, revolver, shotgun, BB gun or air rifle. This section shall not apply to police or law enforcement officers.

12.28.110 - City regulations applicable.¶
Wherever in this code a rule or regulation is stated to regulate activities within the city, the same rule or regulation shall apply with equal force to the Berenda Reservoir and Recreational Park.
