§ 9128.88. Second Primary Units and Two (2) Unit Developments - Deed Restriction.

As a condition of approval of, and prior to the issuance of a building permit for, a second primary unit or two (2) unit development, the property owner shall execute a deed restriction, in a form approved by the City Attorney, which shall be recorded on the property and shall require that the second primary unit or two (2) unit development only be used and developed in accordance with the requirements in CMC § 9128.81 through § 9128.87 . Violation of the deed restriction shall be considered a violation of this Code and may be enforced in a manner that this Code may be enforced.
