Carpinteria Municipal Code Ch. 5.08 Auctioneers

Every person who shall, at public outcry, offer for sale as principal or agent to the highest bidder on the spot, any article or merchandise or personal property, shall be deemed an auctioneer.

Except as hereinafter provided, it is unlawful for any person to sell, dispose of, or offer for sale in the city, goods, wares, merchandise, commodities or any item of personal property, whether the same shall be their own property or whether they shall sell the same as agents or employees of others.

The provisions of Section 5.08.020 shall not apply to judicial sales or sales by executors or administrators, to sales by or on behalf of licensed pawnbrokers, of unredeemed pledges in a manner provided by law, nor to sales covered by the provisions of Chapter 5.24 of this code.

Sales at public auction, other than those regulated by Chapter 5.24 of this code, shall be held on successive days, Sundays and legal holidays excepted and shall not continue for more than thirty days in all from the commencement of the sale and shall be permitted only where such merchant is bona fide disposing of his stock for the purpose of retiring from business.

In no event shall any auction sale of goods as above specified be conducted at public auction between the hours of six p.m. and eight a.m. of the next day.
