5.04.010 - License—Required—Compliance with regulations.

A. It is unlawful for any person, whether as principal or agent, clerk or employee, either for himself or for any person, or for any corporation, or as an officer of any corporation, or otherwise, to commence or carry on any business, show, exhibition or game specified in Chapters 5.04 through 5.24 in the city without first having procured a license from the city to do so, or without complying with each and all of the regulations of such business, show, exhibition or game contained in Chapters 5.04 through 5.24.

B. The carrying on of any business, show, exhibition or game mentioned in Chapters 5.04 through 5.24 without first having procured a license from the city to do so, or without complying with each and every regulation of such business, show, exhibition or game in Chapters 5.04 through 5.24, constitutes a separate violation of this title for each and every day that such business, show, exhibition or game is carried on.

5.04.020 - Application to business exempt by state or federal law.

Nothing contained in Chapters 5.04 through 5.24 shall be deemed or construed as applying to any person, firm or corporation conducting, managing or carrying on, or engaged in any business or occupation exempt from taxation by municipal corporations, by virtue of Section 14, Article XIII of the Constitution of the state of California, or by the Constitution of the United States.

5.04.030 - Application to employees.

Nothing contained in Chapters 5.04 through 5.24 shall be deemed or construed to apply to any person engaged in any of the businesses enumerated in said chapters solely as an employee of any other person, firm or corporation managing or carrying on any such business in the city.

5.04.040 - Application to charities.

The provisions of Chapters 5.04 through 5.24 shall not be deemed or construed to require the payment of a license to conduct, manage or carry on any business, occupation or activity, or require the payment of any license from any institution or organization which is conducted, managed or carried on wholly for the benefit of charitable purposes and from which profit is not derived, either directly or indirectly, by any individual, firm or corporation.

5.04.050 - License—Exemptions.

No license shall be required for the conducting of any entertainment, concert, exhibition or lecture on scientific, historical, literary, religious or moral subjects, whenever the receipts of any such entertainment, concert, exhibition or lecture are to be appropriated to any church or school, or to any religious or benevolent purpose within the city.

5.04.060 - License—Debt to city.

The amount of any license imposed by Chapters 5.04 through 5.24 shall be termed a debt to the city. Any person, firm or corporation engaged in any business, show, exhibition or game mentioned in said chapters without having a license from the city to do so shall, in addition to any penalties provided in this chapter, be liable to an action in the name of the city in any court of competent jurisdiction for the amount of the license imposed by Chapters 5.04 through 5.24 of such business, show, exhibition or game.

5.04.070 - Penalty for violation.

A. Every person, firm or corporation who violates any provision of Chapters 5.04 through 5.24 is guilty of a misdemeanor.

B. Each separate day during which any violation of Chapters 5.04 through 5.24 exists or occurs constitutes a separate offense.
