12.12.010. - Encroachment permit required; fee prescribed for issuance and inspections.

A. No person or entity shall cause encroachment on a city right-of-way or have the same done without first obtaining an encroachment permit to do so from the city.

B. The term "encroachment" includes any object, obstruction, excavation, or event which is in, under, or over any portion of the city right-of-way.

C. The term "right-of-way " includes any city street, alley, path, and parking lot property, excluding city park and city office properties.

D. The director of public works shall establish encroachment permit requirements and procedures.

E. With input from other departments, the director of public works shall issue or deny individual encroachment permits.

F. The city council shall, by resolution, establish and prescribe such fees for the issuance of permits and for making inspections as it deems advisable to properly implement and carry into effect the encroachment permit program of the city.
