10.50.010. - Definitions.

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

A.

Bicycle dealer means any person or entity engaged wholly or partly in the business of selling bicycles, or buying or taking in trade bicycles for the purposes of resale, selling or offering for sale, or otherwise dealing with bicycles, whether or not such bicycles are owned by such person or entity. The term also includes agents or employees of such person or entity.

B.

Bicycle lane means any lane within the roadway designated by signs and markings for the operation of bicycles.

C.

Bicycle license means and includes the license tag or decal designated by the state in accordance with the state Vehicle Code § 39001, to be permanently affixed to the bicycle in the manner required by Vehicle Code § 39001, and which bears a unique number permanently assigned to that bicycle to which it was issued.

D.

Bicycle path means any specifically designated area for bicycle travel, physically separated from the roadway.

E.

Bicycle registration certificate or registration certificate means the ownership card issued by the licensing agency or agent of the police department upon receipt of the designated licensing fee.

F.

Bicycle route means any route recommended for bicycle travel which may include bicycle paths and public streets for accommodating the use of bicycles.

G.

Central business district or central traffic district means all streets and portions of streets within the area described as follows: all that area bounded by the city limits as described in sections 10.52.010 (see Business district) and 10.04.030.

H.

Cyclist means any bicycle operator.

I.

Licensing agency means those persons or entities designated by the chief of police as official licensing agencies for bicycles in the city.

10.50.020. - Bicycle license recommended.

A.

Generally. No person should use, store, park or operate any bicycle, as specified in this chapter, on any street, road, highway or other public property within the city, unless that bicycle is licensed in accordance with this chapter, except as follows:

Special events. Bicycles used for participation in special events such as bicycle races, bicycle safety demonstrations and other singular events are not licensed under this chapter.

2.

Transient bicycle use. Bicycles used in a transient nature by those persons visiting, vacationing or temporarily within the city for periods of less than ten days in any calendar year.

B.

License deemed voluntary and permissive. Notwithstanding any other provision of this chapter, the bicycle license provided for in this chapter is voluntary and permissive and is not mandatory.

10.50.030. - Bicycle registration certificate/bicycle license issuance.

At the time any person voluntarily licenses a bicycle, the licensing agency shall provide that person with a registration certificate bearing the date, owner's name, address, telephone number, bicycle license number, bicycle manufacturer, type and frame number and any other descriptive information deemed necessary by the licensing agent and provisions for the transfer of ownership of the bicycle. At the time of such voluntary licensing, the bicycle owner shall be issued a permanent bicycle license pursuant to Vehicle Code § 39001. The license may be renewed uniformly on January 1 of the third year following the year of registration.

10.50.040. - Sale or transfer of bicycle.

A.

When any persons sells, trades, disposes of or transfers any bicycle licensed pursuant to the provision of this chapter, that person should endorse upon the registration certificate previously issued for such bicycle a written transfer of same, setting forth the name, address and telephone number of the transferer, and should deliver the registration certificate, so endorsed, to the licensing agency within ten days.

B.

Any person who purchases or otherwise acquires possession of a bicycle previously licensed should within ten days of taking possession apply for the transfer of license to the purchaser's own name.

10.50.050. - Lost or stolen license or registration certificate.

In the event that any bicycle license or registration certificate issued pursuant to the provisions of this chapter be lost or stolen, the licensee should immediately notify the licensing agent and within ten days should apply to the licensing agency for a duplicate, whereupon the licensing agent shall issue a duplicate bicycle license and or registration certificate.

10.50.060.

  • Tampering with registration certificate, bicycle plate, serial number prohibited.

A.

It is unlawful for any person to tamper with, destroy, mutilate or in any way alter any registration certificate issued pursuant to the provisions of this chapter.

B.

It is unlawful for any person to remove, destroy, mutilate, or in any way tamper with or alter any bicycle license issued pursuant to the provisions of this chapter.

C.

It is unlawful for any person to remove, alter or mutilate the serial number of any bicycle frame licensed under the provisions of this chapter.

10.50.070. - State authority.

All provisions of state law relating to the operation of bicycles are incorporated into this chapter. Every person operating a bicycle on a roadway has all the rights and is subject to all the laws of this state or by this chapter or any ordinance of this city, except those provisions of laws and ordinances which by their very nature can have no application and except as otherwise provided in this section and sections 10.50.080 through 10.50.100.

10.50.080. - Closing of streets for bicycle racing.

The city council may authorize the temporary closing of a portion of any highway within the city pursuant to Vehicle Code § 21101(e) for the purpose of allowing a bicycle racing event.

10.50.090. - Bicycles on pedestrian bridge.

No person shall ride a bicycle upon' any pedestrian bridge within this city which has been posted with signs prohibiting such use.
