Chapter 14.400 — MOBILE FOOD VENDORS

§ 14.400.010. Purpose.

The following provisions are intended to permit food preparation and sales from a licensed motorized vehicle or a licensed trailer on a parcel located in a nonresidential zoning district for a period of two years, subject to the standards in BMC § 14.400.040 . (Ord. 409 § 3, 2017)

§ 14.400.020. Applicability.

Mobile food vendor permits shall be issued for a period of two years upon the approval of a mobile food vendor permit application form provided by the city planner that includes all information necessary to allow the city planner to determine if the proposed use will comply with the standards in this chapter.

§ 14.400.030. Action on mobile food vendor permits.

Upon review of a completed application for a mobile food vendor permit, the city planner shall issue a permit if the city planner determines that the proposed use complies with all of the standards set forth in BMC § 14.400.040 . Mobile food vendor permits shall be approved or denied in writing. All

denials shall state the reasons for the denial. Reasons for denial shall be limited to a finding by the city planner that the proposed use is not permitted in the applicable zoning district or that the use does not comply with one or more of the requirements of BMC § 14.400.040 . § 14.400.040. Operating standards.

Food vendors shall comply with all of the following operating standards:

  • (1) Comply with all federal, state and local laws and regulations, including but not limited to, those of the city of Biggs and the Butte County department of environmental health.

  • (2) Hours of operation shall be limited to 9:00 a.m. to 9:00 p.m. daily when adjacent to a residential zoning district, and limited to 6:00 a.m. to 10:00 p.m. when adjacent to a nonresidential zoning district.

  • (3) Store the mobile vehicle or trailer off premises during nonbusiness hours. All associated equipment, including tables and chairs, must be stored either off premises or out of sight within an existing structure if on premises.

  • (4) Keep the site free of litter and debris generated by the business at all times. The permittee shall provide trash and recycling receptacles for customer use. Any waste associated with the mobile food vendor shall be removed daily from the site.

  • (5) All waste discharges are to be done at a facility approved by the city planner, or a grease interceptor must be installed on site. If requested, the permittee must provide to city planner the name and address of where the wastewater is discharged.

  • (6) Outdoor speakers and outdoor music shall not be permitted on the site. Signs shall be permitted on the vehicle only.

  • (7) Any connection of the vehicle to an existing or new electrical service shall be inspected and approved.

  • (8) Customer parking shall only be allowed in striped parking stalls. The permittee shall post a sign on the mobile food vendor during open hours stating this requirement.

  • (9) Permittee shall coordinate with the property owner to make restrooms available as needed to customers and employees.

§ 14.400.050. Mobile food vendors not meeting operating standards.

A mobile food vending business which does not meet the operating standards of this chapter shall apply for a use permit in compliance with Chapter 14.60 BMC (Conditional Use Permits). (Ord. 409 § 3, 2017)
