7-3-501: PURPOSE:¶
The city council finds that installation of one or more speed humps on certain residential streets in the city is required to reduce vehicular speeds, traffic volume, traffic hazards and accidents caused by excessive vehicular speed. The city council also finds that it is necessary to establish a procedure for considering requests by residents for the installation of speed humps on their streets and to allow citizen input prior to such installation. 7-3-502: DEFINITIONS:¶
For purposes of this article, certain words are defined as follows:
ELIGIBLE APPLICANT: A property owner or tenant residing on a street block who proposes the installation of speed humps on the street block where the property owner or tenant resides.
PROPERTY OWNER: The owner of a residential dwelling unit and/or complex on the street block proposed for installation of speed humps.
SPEED HUMP: A strip of raised pavement on a street running perpendicular to the flow of traffic, installed for purposes of reducing vehicular speed.
SURVEY: The form approved by the director of transportation for persons who own property or reside on streets where speed humps are proposed to be installed to express their consent or objection to such installation pursuant to section 7-3-506 of this chapter. (Ord. 93-O-2163, eff. 2-26-1993)
7-3-503: APPLICATION FOR INSTALLATION OF SPEED HUMPS:¶
An eligible applicant may submit an application, on a form approved by the city, to the director of transportation requesting installation of one or more speed humps on the eligible applicant's street block. (Ord. 93-O-2163, eff. 2-26-1993)
7-3-504: CRITERIA FOR DETERMINATION OF ELIGIBILITY FOR INSTALLATION OF SPEED HUMPS:¶
A. The director of transportation shall review the application and determine whether the street block proposed for speed humps complies with technical eligibility standards based on the Institute Of Traffic Engineers standards and other relevant factors, such as, traffic volume, street width, accident frequency, block length and curvature, and grade of street.
B. If the director of transportation determines that the street block specified in the application is technically eligible for installation of one or more speed humps pursuant to subsection A of this section, the director of transportation shall identify in priority order the appropriate potential locations for installing speed humps on such block. 7-3-505: PROCEDURE FOR OBTAINING PROPERTY OWNER CONSENT FOR THE PLACEMENT OF SPEED HUMPS:¶
A. Upon a written determination by the director of transportation that the street block specified in the application satisfies the requirements of subsection 7-3-504A of this chapter, the eligible applicant shall obtain written approval from the property owners whose property will abut the proposed speed hump as shown in figure 1 of this section. A property owner is entitled to provide one consent or one objection to the proposed speed hump with respect to that property.
If the property abutting the proposed speed hump is a condominium, the eligible applicant shall obtain written approval from the property owner(s) whose window(s) face the street in which the proposed speed hump will be located. A property owner whose window(s) face the street in which the proposed speed hump will be located is entitled to provide one consent or one objection to the proposed speed hump with respect to that condominium.
If the property abutting the proposed speed hump is an apartment development, the eligible applicant shall obtain written approval from the owner thereof. The owner of an apartment development is entitled to provide one consent or one objection to the proposed speed hump with respect to the entire apartment development.
In cases where the dwelling unit is not occupied, the property owner or an authorized representative may consent or object to the proposed speed hump.
B. The eligible applicant shall contact the property owners, described in subsection A of this section, in the priority order determined by the director of transportation as the best suited locations for installation of speed humps on the street, pursuant to subsection 7-3-504B of this chapter.
C. Should any property owner on such list object to the installation, the eligible applicant shall obtain written approval from the property owners identified by the director of transportation as the next best location for installation of speed humps pursuant to subsection 7-3-504B of this chapter.

7-3-506: PROCEDURE FOR OBTAINING APPROVAL FROM PERSONS OR ENTITIES TO INSTALL SPEED HUMPS:¶
A. Upon obtaining written approval from abutting property owners for installation of one or more speed humps at certain locations, as set forth in section 7-3-505 of this article, the department of transportation shall mail to the persons or entities listed below an informational brochure describing the proposed installation of speed humps and a survey requesting such persons or entities to identify whether they approve of or oppose the installation at the specified location. The following persons or entities shall receive an informational brochure:
The property owner or tenant residing in a single-family residence located on the block proposed for installation of speed humps.
The property owner or manager of an apartment development located on the block proposed for installation of speed humps.
The president of the homeowners' association for any condominium development located on the block proposed for installation of speed humps.
B. The persons or entities entitled to receive surveys shall return the surveys to the department of transportation within sixty (60) days of the date the notices are mailed by the city.
C. At least sixty percent (60%) of the persons or entities entitled to receive surveys must approve installation of one or more speed humps at the specified location before the humps may be installed. If less than sixty percent (60%) of such persons approve the installation, the application process shall terminate.
D. In determining the percentage of persons or entities who approve of or oppose installation of one or more speed humps, the department of transportation shall consider the returned surveys in the following manner:
A property owner or tenant residing in a single-family residence shall be entitled to one consent or one objection for that residence.
Each apartment development and each condominium development shall be entitled to one consent or one objection for the entire development. (Ord. 93-O-2163, eff. 2-26-1993)
7-3-507: PERIOD FOR APPLICATION PROCESS:¶
A. An application shall remain active for a three (3) month period following the mailing of the survey by the department of transportation pursuant to subsection 7-3-506A of this article. In the event that the required number of approvals are not received in accordance with section 7-3-506 of this article in such three (3) month period, the application shall expire and have no further force or effect under this article.
B. An eligible applicant can reapply for installation of one or more speed humps on a block one year from the date that the original application expired. (Ord. 93-O-2163, eff. 2-26-1993)
7-3-508: REQUESTS TO REMOVE SPEED HUMP(S):¶
A. A resident may make a request to remove a speed hump(s) by filing an application therefor with the traffic and parking commission.
B. An application to request traffic and parking commission approval of the removal of a speed hump(s) shall only be considered if such hump(s) have been installed for at least two (2) years, except as otherwise provided in subsection C of this section.
C. Under special circumstances, including, but not limited to, significant noise and safety problems, the traffic and parking commission may approve removal of speed humps.
D. Any decision of the traffic and parking commission made under this section shall be appealable to and reviewable by the city council pursuant to title 1, chapter 4 of this code. (Ord. 93-O-2163, eff. 2-26-1993)
7-3-509: CITY COUNCIL AUTHORITY:¶
The provisions of this article shall not be construed to limit in any manner the city council's power to order the installation or removal of speed humps without complying with the provisions of this article. (Ord. 93-O-2163, eff. 2-26-1993)
