7-3-301: OVERNIGHT PARKING PROHIBITED WITH CERTAIN EXCEPTIONS:¶
A. No person shall park a vehicle on any roadway in the city between the hours of two thirty o'clock (2:30) A.M. and five o'clock (5:00) A.M. on any day, unless otherwise provided herein.
B. The following vehicles are exempt from the provision of subsection A of this section:
Any vehicle registered with the state department of motor vehicles to a disabled person as defined in section 22511.5 of the Vehicle Code of the state and bearing a distinguishable license plate or placard issued by the state department of motor vehicles, subject to the provisions of subsection C of this section;
Any vehicle which cannot be parked off the roadway because of construction activity, and the department of transportation has been notified;
Any vehicle parked in a nonresidential zone for only such time as the person parking the vehicle shall be performing services pursuant to a valid city business license;
Any vehicle parked for an existing emergency purpose;
Any vehicle which has a ladened or gross weight of less than six thousand (6,000) pounds and displays a permit issued under section 7-3-303 or 7-3-306 of this article.
C. The exemption from the provision of subsection A of this section for vehicles registered to a disabled person shall be subject to the following restrictions:
- Vehicles registered to a nondisabled driver of a disabled person are not exempt.
- Only vehicles registered to city residents are exempt.
- Only one vehicle per disabled person is exempt.
- Only vehicles parked on the street block adjacent to the registered owner's dwelling unit are exempt. (Ord. 96-O-2262, eff. 7-19-1996; amd. Ord. 99-O-2334, eff. 10-22-1999)
7-3-302: APPLICATION FOR OVERNIGHT PARKING PERMIT FOR RESIDENTS OF MULTIPLE-FAMILY…¶
An application for overnight parking may be filed with the city by an occupant of a multiple-family residential dwelling unit subject to the following requirements:
A. Payment of the overnight parking fee established by council resolution.
B. Completion of an application on the form designated by the police department.
C. Compliance with such rules and regulations governing overnight parking permits as issued by the chief of police or designee.
A single-family residence improved with one or more an accessory dwelling units shall not be considered a "multiple-family residential dwelling unit. (1962 Code §§ 3-6.2304, 3-6.2305, 3-6.2306, 3-6.2309, amd. Ord. 96-O-2262, eff. 7-19-1996; Ord. 25-O-2927, eff. 12-13-2025)
7-3-303: ISSUANCE OF OVERNIGHT PARKING PERMIT TO RESIDENTS OF MULTIPLE-FAMILY…¶
A. An overnight parking permit may be issued by the chief of police or designee to an occupant of a multiple--family residential dwelling unit only if the applicant meets each of the following conditions:
There is no available parking space upon the premises which the applicant resides.
No former parking area on the premises has been converted to and is presently used for other purposes without approval of the city.
The vehicle for which the permit is requested is registered to the applicant, rented or leased by the applicant, or used on a full time basis by the applicant. The applicant shall hold a current and valid driver's license to operate a vehicle.
There is insufficient off street parking facilities in the area of applicant's residence.
The applicant has diligently attempted to obtain off street parking and there is no usable off street parking available.
The applicant is not a resident of an ineligible project, as defined in section 7-3-203 of this chapter.
B. The maximum number of permits which may be issued shall not exceed three (3) for any dwelling unit, except as provided in subsection C of this section.
C. The chief of police or designee has the authority to grant additional overnight parking permits upon application of qualified applicants and proof that more than three (3) vehicles are registered to the legal occupants. The total number of parking permits issued for any dwelling unit shall not exceed the number of legal occupants of the dwelling unit that hold a current and valid driver's license.
D. Any preexisting resident (as defined in section 7-3-203 of this chapter) may continue to use their overnight parking permit for the duration of their continued residence in an ineligible project (as defined in section 7-3-203 of this chapter), provided the preexisting resident (a) held a valid overnight parking permit or permits prior to the residential development becoming an ineligible project, and (b) has timely renewed their overnight parking permit or permits. Preexisting residents may not apply for a new overnight parking permit to replace an expired permit, and may only renew the same number of overnight parking permits they had at the time the residential development became ineligible; provided, however, a preexisting resident may apply for a new overnight parking permit if, after the date the residential development became an ineligible project, the preexisting resident (i) possesses a valid driver's license, and (ii) obtains a vehicle registered to the address of the preexisting resident.
E. Residents who move into an ineligible project shall not be allowed to receive an overnight parking permit; provided, however, such residents may apply for an overnight parking permit if (i) they reside in the same dwelling unit as a preexisting resident, (ii) possess a valid driver's license, and (ii) possess a vehicle registered to the address of the preexisting resident.
F. A property owner of a residential development that becomes an ineligible project shall notify in writing all existing tenants of the change in the project's status on or prior to the date on which the residential development becomes an ineligible project. In the event that the property owner fails to timely notify any tenant of the change in the project's status, the penalties and procedures in Title 1, Chapter 3 of this code shall apply. In addition to the other penalties provided in this code, if a property owner fails to provide the notification required under this subsection, the property owner shall also be liable for any costs and attorney fees incurred by the city in abating or collecting fines for parking code violations attributable to the tenants of the residential development during the duration of the violation.
G. A property owner shall notify in writing all prospective tenants or purchasers of dwelling units who are ineligible to receive an overnight parking permit of their ineligibility. Upon leasing or sale of a dwelling unit or accessory dwelling unit to a tenant or purchaser who is ineligible to receive an overnight parking permit, the property owner shall collect a written acknowledgement of the ineligibility signed by the tenant or purchaser. In the event that the property owner, or their designee, fails to notify any tenant or purchaser of their ineligibility to receive an overnight parking permit, the penalties and procedures in Title 1, Chapter 3 of this code shall apply. In addition to the other penalties provided in this code, if a property owner fails to provide the notification required under this subsection, the property owner shall also be liable for any costs and attorney fees incurred by the city in abating or collecting fines for parking code violations attributable to the tenants or purchasers of the dwelling units during the duration of the violation. 7-3-304: TERM OF PERMIT FOR MULTIPLE-FAMILY RESIDENTIAL DWELLING UNIT OCCUPANT:¶
Permits issued under this article to multiple-family residential dwelling unit residents shall be valid for a period of up to one year from date of issuance, or until the permittee ceases to reside in the designated unit, whichever occurs first. Upon expiration of a permit, a new application or renewal for a permit must be filed as provided in this article for any subsequent permit. (1962 Code §§ 3-6.2310, 3-6.2312; amd. 7-3-305: APPLICATION FOR OVERNIGHT PARKING PERMIT FOR USE BY AN ON DUTY REGISTERED NURSE:¶
An application for a permit authorizing overnight parking may be filed by a registered nurse performing nursing services at night, subject to the following requirements and restrictions:
A. Payment of the overnight parking fee established by council resolution.
B. Filing of an application on the form designated by the chief of police or designee.
C. The application shall be accompanied by a written statement from a licensed physician that the patient which the nurse is attending during the night is seriously ill and requires twenty four (24) hour per day nursing care.
D. Compliance with any rules or regulations governing overnight parking permits as issued by the police chief. (Ord. 96-O-2262, eff. 7-19-1996; amd. Ord. 25-O-2927, eff. 12-13-2025)
7-3-306: ISSUANCE OF PERMIT TO REGISTERED NURSE:¶
An overnight parking permit may be issued by the chief of police or designee to a registered nurse only if the following conditions are met:
A. There is no on site parking for the nurse on the patient's premises while attending the patient.
B. Use of a vehicle is reasonably necessary for commuting to the patient's premises.
C. The registered nurse applicant is engaged in rendering services to a seriously ill patient between the hours of two thirty o'clock (2:30) A.M. and five o'clock (5:00) A.M. (1962 Code § 3-6.2301; amd. Ord. 25-O-2927, eff. 12-13-2025)
7-3-307: TERM OF PERMIT FOR REGISTERED NURSE:¶
Permits issued under this article to a registered nurse shall be valid for a period of thirty (30) days. Upon expiration of a permit, a new permit application may be filed as provided in this article for issuance of a subsequent permit. (1988 Code)
7-3-308: PROHIBITIONS AND RESTRICTIONS ON OVERNIGHT PARKING PERMITS:¶
A. No vehicle shall be parked or stopped between the hours of two thirty o'clock (2:30) A.M. to five o'clock (5:00) A.M. unless such vehicle shall have a valid overnight parking permit issued by the city.
B. It shall be unlawful for any person to sell, rent, or lease, or cause to be sold, rented, or leased, for any value or consideration any overnight parking permit. Upon violation of this subsection, all overnight permits issued to, or for the benefit of, the dwelling unit for which the sold, rented, or leased permit was authorized shall be void.
C. It shall be unlawful for any person to buy or otherwise acquire for value or use any overnight parking permit, except as provided for in this article. (1962 Code § 3-6.2315; amd. Ord. 96-O-2262, eff. 7-19-1996; Ord. 25-O-2927, eff. 12-13-2025)
7-3-309: REVOCATION OF PERMIT:¶
Where any permit issued under this article has allegedly been procured through fraud or misrepresentation, or where the permittee has allegedly violated provisions of this article, the chief of police or designee shall hold a hearing, with notice of the time and place of such hearing mailed to the permittee at least five (5) days preceding the hearing. If, after the hearing, the permit is determined to have been procured through fraud or misrepresentation or where it is determined that the permittee has violated the provisions of this article, the permit shall be revoked its. The permittee shall be mailed written notice of the revocation and the reasons therefor. (1962 Code § 3-6.2316; amd. Ord. 25-O-2927, eff. 12-13-2025)
7-3-310: APPEAL TO THE TRAFFIC AND PARKING COMMISSION:¶
Any decision of the chief of police or designee in granting, denying, or revoking a permit under this article may be appealed to the traffic and parking commission. The appeal shall be in writing, and shall be filed with the commission within fourteen (14) days of the decision. The decision of the traffic and parking commission to uphold or reverse the decision of the chief of police or designee shall be final. (1962 Code § 3-6.2317; amd. Ord. 25-O-2927, eff. 12-13-2025)
7-3-311: ADMINISTRATIVE REGULATIONS:¶
The chief of police or designee shall have the power and authority to promulgate rules and regulations for the implementation and enforcement of provisions of this article, and when duly promulgated, such rules and regulations shall be in full force and effect. Such rules and regulations shall be posted on the City's website and made available at City Hall. The holder of an overnight parking permit shall comply with such rules and regulations and any violation of such rules and regulations shall constitute a violation of this code.
