1-6-101: CLAIMS PROCEDURE:

The provisions of this chapter implement procedures for processing claims against the city in accordance with the state Government Code section 935. Procedures under title 1, division 3.6, part 3 commencing with section 900 of the state Government Code shall be applicable except as otherwise provided in this chapter. (1962 Code § 2-2)

1-6-102: FILING WITH CITY CLERK:

All claims and demands against the city shall be filed with the city clerk. (1962 Code § 2-2)

1-6-103: ADDITIONAL MATTERS REQUIRING FILING OF CLAIMS:

In addition to the requirement of state Government Code section 905, and notwithstanding the exemptions thereto, a claim filed with the city shall be a prerequisite to suit in the following matters:

A. Any claim by public officers or employees for fees, salaries, wages, overtime pay, holiday pay, compensating time off, or vacation pay, sick leave pay, or any other expenses or allowances claimed due from the city, when a procedure for processing such claims is not otherwise provided by state or local laws, shall be presented within the time limitations and in the manner prescribed by sections 910 through 915.2 of the state Government Code; and such claim shall be subject to the provisions of section 945.4 of the state Government Code prohibiting suits in the absence of the presentation of such claim and action thereon by council.

B. Any claim against the city for damages or money, when a procedure for processing such claim is not otherwise provided by state or local laws, shall be presented within the time limitations and in the manner prescribed by sections 910 through 915.2 of the state Government Code; and such claim shall be subject to the provisions of section 945.4 of the state Government Code prohibiting suits in the absence of the presentation of such claim and action thereon by council. 1-6-104: PROCESSING OF CLAIMS:

The director of human services, with the approval of the city manager, shall adopt and implement procedures for the processing of claims consistent with the provisions of the state Government Code, provisions of this article, and any regulations adopted by council. (1962 Code § 2-2)
